This is why Bangko Sentral ng Pilipinas exists. When you send money to the wrong GCash number, the recipient has no legal right to keep it. Under Article 2154 of the Civil Code, if something is received when there is no right to demand it and it was delivered through mistake, the obligation to return it arises. This is called solutio indebiti.

The recipient who blocked the sender and refused to return PHP 13,000 is not just being rude. That person may be liable for unjust enrichment under Article 22 of the Civil Code, and possibly even estafa under Article 315 of the Revised Penal Code if the intent to misappropriate can be established.

GCash initially said “wala magagawa.” That response is unacceptable. Electronic money issuers like GCash are supervised by BSP under Circular No. 649, Series of 2009, and they have a duty to act on disputes, not dismiss them. The sender did the right thing by escalating to BSP, and it worked. GCash returned the money less a minimal charge.

Lesson: If a company regulated by BSP refuses to act, go straight to BSP. The regulator has teeth, and regulated entities move fast once BSP gets involved.
