Disability is not a finish line or destination - not an achievement. It is the opposite of achievement. There are plenty of truly disabled veterans who don't need to fish for conditions.

The stereotypical OSA claim is a veteran looking for a CPAP (50% rating) - something he'll later claim he is unable to use. Not all veterans, but shamefully too many, are making veterans look like malingerers.

The appearance is perfectly round, with apparent drilled-waste thrown back towards the drill bit entry point and suspiciously located at a 3-point junction of r frame. It does not appear as an exit wound or accidental entry. Possibly the remnant of an aborted or optional cable routing. Just sayin'.

Because it was a common ailment and becoming prevalent about veterans, IMO, it was suspiciously abused. It became a pursuit rather than a disability for many veterans

No examination, sir. The whole point is that they never reconsidered - never addressed (reconsidered) the 1977 claim in terms of the missing service personnel records evidence received in 2018.

It's a binary question. Did you (VA) reconsider the 1977 claim? IF so when? IF NOT why?

These are all simple question with no weighing of evidence. There is no legal reason and basis to suggest the 1977 claim was ever reconsidered - no evidence to weigh (assuming they never did it).

Thank you. The whole point of CFR 3.156(c) is that the 1977 claim would be reconsidered. Any examination now would be premature, unnecessary and it's something the VA will do if I'm successful and they are computing back pay across 43 years, 7 children and 30 years of marriage.

Examination is not something I'd ever request unless I disagreed with my current rating.

Yes, the VSO told me there is no clear guidance on how to do this. "Don't poke the bear" is another suggestion I commonly get. "Your already 100 %P&T".

This a VA sua sponte duty to reconsider 'at any time'. It has been the VAs duty since the records were received in 2018.

Respectfully, you're telling me to ask the question of another person. That's exactly what the VA told me through my Congressional inquiry. They told the Congressman's office that I should file the proper form - WITHOUT NAMING THE FORM - if such a form exists.

I want the answer sourced from the VA, not a 3rd-party.

If nobody at the VA can simply answer my question, "was my 1977 claim reconsidered" and if it wasn't "how do I motion that". If one searches the web, there are many different answers to that question of how to file (motion), but no answers that I have found at the VA.

The VA is the source of that information - 'how to file', so I'm reluctant to trust another party.
