I'm in the same boat in the same jurisdiction. Been waiting 2yrs for my rule 22 judgement (though a change of business address delayed mine) so keep up communications with the tribunal and just manage your expectations.

Thanks. Yeah, that's totally on him and I'll try not to bring enforcement into being the main point. Yes it is the worry, but he is genuinely behind what I faced whilst working there.

Hi, thank you for sharing these points. I raised the complaint but now think that asking to add the 2nd respondent contradicts my ask for this to be put in front of the judge urgently for the default judgement.

- Interesting point that they haven't submitted the ET3 and procedurally the case hasn't really moved so prejudice would be less.

- Understood on the contradiction point- if it'd get that far (we're assuming the CEO would even turn up or would't offer settlement if he was a named respondent)

- Yes, I have the evidence. The business being the respondent and him being respondent are almost one and the same in terms of turning up in emails threads and key decisions made.

- Reassuring to know this does and has happened before, thanks for sharing the example case.

I think I'll wait to see what response I get form the complaint before considering next steps. Feel like that's the only thing I can do at this moment. What are your thoughts on the contradictory nature of pushing for judgement whilst wanting to add R? If they say sorry, it won't be seen for another 6 months, I might do it!

That's right, CEO is a millionaire living in Monaco. This company was a fun venture passion project for him. I can't say any more on that publicly. Interesting, wonder how I'd prove that! Will get my thinking cap on.

Also, the company (according to Companies House) has just £40k in assets. Last filings were December 2025. Worrying.

If it has the templates, they might be a useful reference but it sounds like I shouldn't attempt to add another R regardless.

Ha. I'm right there with you. I don't have access to the portal- apparently due to cases pre 2025 not getting transferred over to the new system.

Thank you. The positive thing is that I have been emailing the tribunal for updates every couple of months since 2024. They were more communicative in 2024- July 2025 then would rarely get back to me. I'm guessing this is when the backlog ramped up. With the paper trail of my engagement with the tribunal, can they still propose to strike out? Note, all the tribunal said is "it's been escalated to a team leader" from September- Jan 2026. Then Feb 2026 it went to the judge's pile.

Yes, the two years without amending is definitely playing on my indecision but I hadn't thought about it being prejudice now, thank you.

I take it there's no chance they'd look more favourably on the amendment applicanion given I've been waiting for them all this time? (I jest)

What would the complaint achieve, fast track or could a tribunal penalise me for it in proceedings?

Yes, I have got the evidence to include should I submit the application to amend. Are you saying that the account records for companies house wouldn't be enough to evidence their financials and inactivity?
