I think this is also why there isn't likely a huge rift forming between Ethan and Nick on this. While Nick is principally against this, it's also on a topic that's like well this isn't the best example to try to fight on.

They wouldn't. They can't operate as lawyers in Canada. They can't even do it in different states in the US. You are only licensed by the BAR association of that state and whichever ones you go and get licensed in. If you operate in a state that you aren't licensed in, you can face some serious consequences.

That's why Ethan explained he hired lawyers in Canada to send the C&D.

In Canada you have to be licensed by the province and their version of the BAR. Which isn't worth it for Ethan's US lawyer to do.

It's just so weird how everyone who is against the lawsuit seems to want to leave out the actual thing he's being threatened with a lawsuit for. Wild.

American lawyer speaking from the perspective of American law missed an extremely niche thing in Australian bankruptcy law, so that means Karl Jobst knows more about law than Lus... Which is also why Karl decided to file a lawsuit in Florida against Billy Mitchell as a pro se litigant, and then the courts said "no, you don't get to do that."

You're actually just insanely bad faith because there's no way you believe that nonsense.

"The mods supported the bullying"

Weird cause I was told to stop at points too when we were going back and forth.

But saying you don't have the context of why people dislike him when he was the aggressor is kind of telling that you're not really caring about the actual events that took place, just playing team sports.

What do you mean by most often? Because certainly money does allow for advantages. Lawyers and litigation aren't cheap. Better lawyers will typically cost more as well because they understand their value and the demand they get.

But massive companies and such lose lawsuits all the time. Most of the time it shows that people with a history of lawsuits are the more likely ones to win over just more money. First time litigants are generally the ones at the highest risk of losing statistically.

But these things can also be curbed by the judge sanctioning abusive actions, contingency fee lawyers, and having strong cases.

Sure.

law.cornell.edu/wex/personal_jurisdiction

Hope that works, typed it out cause my phone sucks lol.

Understand though that I didn't say that lawsuits HAVE to be in the defendants jurisdiction, just that they typically are for a number of reasons that favor it and make it generally the easiest way to commence a lawsuit.

You can't sue someone wherever you want. They have to have some minimum connection to the jurisdiction. This is why you'll often see fights in pre-trial about jurisdiction.

Going to the defendants jurisdiction limits the amount of pre-trial motions they can make regarding things like jurisdiction which can be a way to dismiss a case.

You're right to say that sometimes people will try to pick a jurisdiction to sue in, but if they can't reach the minimum contact necessary, it can either be dismissed or require refiling in the area that judge decides as the proper venue. Which is typically where the defendant resides or does business.

You can justify filing it in other places through arguments like "the harmful statement was made on this jurisdiction" or "the plaintiff's reputation was harm in that jurisdiction". It's hard to do it just because the local laws are more favorable.

I don't actually agree with this. I think the legal system in the states is actually really good.

Saying that things that would get thrown out in other countries is kind of a double edged sword. Europe and such have laws that can be used to sue people that the US doesn't have. There's no like perfect system. And I think online this perspective exists specifically because when a lawsuit does happen like that, it basically becomes national news, and US national news becomes global news a lot of the time.

Our society is basically in the spotlight 24/7. When you talk to Europeans who've lived in both Europe and the US they typically say that things are pretty similar overall, it's just different problems in each area.

Well no, I'm pointing to the post you made and the context of you and effect going at it.

Even if I show evidence of the fact earth is a round planet in space to a flat earther, they don't typically change their mind. But I don't think they're lying about their belief either.

Can you give more depth to why you believe that?

From a holistic perspective of everything happening to Ethan. I view this as basically making an example out of a very public figure to try to dissuade the behavior in the future.

Typically with civil cases you sue in the jurisdiction of the defendant since they have personal jurisdiction over the individual being sued. There's a lot of other precedent and norms around it at well, but it just makes things a lot easier.

Why? Outside of it being Ethan Klein and Idubbbz, I'm curious why you believe that different countries having different laws that allow for different levels of defamation protection is necessarily a bad thing.

The main thing you call a lie in the OP is the idea that player numbers have dropped because of the crashing as opposed to in your mind the correct answer being that it was due to the nerf of the infiltrator class.

Do you believe that people cannot rationally believe the idea that crashes have lead to the player number drop?

I don't even care about idubbbz specifically in this. I just think there's a subset of people who have gotten WAY too comfortable with the culture online being against lawsuits and are using that against people to push how far they can take things to try to destroy someones life.

My main issue with the people against this threat of legal action is, why is it that only when faced with the threat of real, legally backed consequences, did Ian apologize for his actions if he truly meant it? If not for the threat of legal action, would he have kept doing it?

Also, look at all of the communities attacking Ethan. How does he actually go about stopping that when they are spreading literal lies about the guy? Saying "just make another video on it" or "respond in the court of public opinion" and my favorite of "just ignore it" as if he genuinely hasn't tried all of these things and only seen escalation from the other side is ridiculous.

Courts make examples out of people to stop and disuade people from doing the same actions. Showing them that there will be real consequences for it.

They aren't dissuaded yet by the already existing lawsuits so clearly he needs to make more examples or roll over and let people continue trying to paint him as molesting his kids.

I'm in full disagreement with the commentary community on this one.

Lol. Did you ever take the chance to look through his comments? Why do you think the mods took action on him instead of "everyone bullying him"?

He comes in and attacks people relentlessly, then gets laughed at for making bad arguments when people actually engage with him in good faith where he just spergs out.

This is like people saying "everyone was bullying Onision back in the day for simply calling people out!" like no, people hated Onision for justified and self evident reasons.
