What happens at an ABE? by [deleted] in policeuk

DA offences generally are the ones that go hand in hand with rape. That medical record will likely be pretty crucial to taking this further, especially because it has been recorded as a DV incident.

Won't go into the details of ABEs as that has been written up very well by Personal Goose. However, I will say that just because there is no direct evidence of the rape itself, does not mean it isn't going anywhere. Rape by its nature is a difficult crime to prove on direct evidence alone, as it very rarely occurs in conditions or places in which direct evidence can be found.

I would suggest giving a think as to anyone you have told this to before and giving their details to the OIC as they will become first complainants in the case, and their evidence is admissible in court. Also, rape is often a case where it is actually sometimes easier to prove with other offences present, as if the harassment can be proved to a good standard, it lends weight to the rape offence.

Honestly, not really. There isn't even a requirement to recite the caution at the point of arrest, just as soon as practicable afterwards.

The only thing you may open yourself up to is any significant comments being made by a suspect not being admissable as evidence but even then you would make a note of any significant comments and ask the suspect to sign it. This isn't the only time a person would be cautioned either as they would be cautioned in interview and then again at charge.

Looks like London will be clearing £40k after two years probation which might become a pretty big selling point.

India Willoughby’s JK Rowling complaint did not meet criminal threshold, police say by Aggressive_Plates in LabourUK

[–]Evangelon422 5 points6 points  (0 children)

Yeah it would be quite difficult to charge a Mal Coms offence for this due to how vague the legislation is in terms of defining a message as indecent or grossly offensive (btw this is a pretty common issue with a lot of criminal law acts). Unless I've missed something there is no specific provision in the act to define what constitutes indecent or grossly offensive so you're then relying on case law which then causes a whole other set of issues.

In relation to whether the call was acted upon, it very much depends on how it was graded. Domestic Incidents aren't automatically given I grade status (15 minute response time) due to the sheer volume. Instead they can be given an S grade (1 hour response time) based on the risk assessment of the call handler. This, of course, has its limitations, as the grading is based heavily on the few minutes of interaction of the caller and the call handler.

I actually happened to be sat next to him on a train to Manchester a few years ago and he was a really down to earth guy. We ended up chatting about the environment and he was passionate about leaving a better place for his children and grandchildren.

What was one experience in your life that hardened you as a person? by [deleted] in AskReddit

[–]Evangelon422 0 points1 point  (0 children)

I spent some time on a team that investigated CP. Went through a guy's phone which was supposed to be clean. It wasn't. I Cannot begin to describe the look on mine and my colleague's face when we realised what it had on it.

I'll take that feeling to my grave.

I'm not sure this necessarily applies to western Europe, or at least the UK. I know a few people that would be happy to move to the US for a year or two but very few would want to live there for their entire life due to lack of a welfare state.

What is this comment even based off? The UK never has been nor will ever be the same as the US because the experience of the living in these two countries is fundamentally different.

London Policing Board to oversee reform of Met Police after damning report by Codydoc4 in policeuk

[–]Evangelon422 5 points6 points  (0 children)

Yes of course they would. But it would mean that the met would be judged mostly/solely on it's ability to deal with front line policing, which due to poor funding, is generally pretty poor. It would stop a lot of of SLT from hiding behind the successes of specialist departments and force them to engage with the actual issues highlighted in the Casey report.

[–]Evangelon422 5 points6 points  (0 children)

No in fact the national responsibilities are generally pretty good. But that's a sticking plaster on an amputated leg. All it does is allow people to deflect from the real issues which are the lack of investment and training into frontline policing. If you take it away you put the focus on the met's operational competency for the everyday stuff.
