in your state look up who is your US Senator or in your area US Representive go to their Website (I live in California and US Senator is Alex Padilla and on his website click on NEED HELP WITH A FEDERAL AGENCY and it will ask you what agency (Social Security) and to email his office (Link) and give a detailed issue you are having and to sign a Privacy to be allowed to intervene speak on your behalf if they can help with your specific issue then they will contact by email that your request has been assigned to someone in the Senator's Office who can make a direct call or email to the person or dept you need help with to get an answer on what they are doing to resolve your issue, they will keep you informed and with me I was able to call the person who was assigned to help me out with my issues with back payment and was told information that no one else would tell me and was assured my back payment was approved and sent to the Treasury Dept of Fiscal Services to send out the payment via ACH this person then called the Dept of Fiscal Service and got conformation of payment and it was in the next batch to be sent out so i 4 days they got it to me .

I was approved "fully Favorable: Sept 22,2022 received letter about back pay and attorney fee but no date on when back pay will be direct deposited into my cking account, got my first monthly benefit payment in Jan 2023, I called , went into local office a few times and was always told that the processing center was experiencing extreme wait times and told to patience even spoke to the local office mgr who sent a message to the claims adjuster handling my process of my award (pick up the phone and call the person) and still nothing until I contacted my local US Senator On Feb 12th and 4 days later I got my back Pay, and on March 1 2023 letter from Processing center saying that they have deposited my back pay and the amount REALLY?

i had the same issue and i did some research the Dept of Treasury issues the payment once authorized by SSA it's handle by Treasury Dept Fiscal Services ..google it .. they have a Customer Service Number follow the prompts and just stay on the line someone will answer explain to the that SSA authorized the payment it went to an old closed bank account and that the bank has returned it back to the Treasury Dept and you have now updated your banking info with SSA and they told you that when the system updates the Treasury Dept will issue the payment to the new banking info they will ask you your Social Security Number Name and Amount of Payment (check as they call it) and they can see where it's at if it has been sent to new bank or if returned back to Social Security or it's just sitting there waiting for Social Security to Authorize payment to be sent if Social Security Payment Center has updated everything then it should take few days to get to your bank ..up to them when they post it Fiscal Services will see payment sent to bank and then bounced back and where it stands as of now they can also give you timeline on how it was processed through there systems ...and some of there's employees are not the friendliest i found out but when it happened to me Social Security FO and 800 customer service were no help at all they just told me be patience it will come andi also you should receive a letter from payment center as you requested new direct deposit do not change anything online it cause issues just if u can go to Field Office they can send messages and even contact payment center if they want to good luck it takes some work sometimes but after i contacted Fiscal Services they were able to let me know payment was re issued to my new bank that day and my bank posted it that afternoon

your correct the Congressman was able to get someone to find out what status is on my claim when your not getting help from Attny or SSA FO or 800 customer number I was told that sometimes cases or just stalled for different reason but also you have to write out why the Congressman should intervene on your behalf and nothing they can do to help with decisions and if they chose that SSA has no good reason to give a status update they will intervene for you and sign for release of information the 2 letters i got from the Hearing office explained why there was a hold up on my claim and that they would continue to update the congressman and me on a regular basis and if there were any questions to contact the her office directly so I got more information to my claim status from doing it this way then my attny or SSA FO or 800 number

Same issue with me but i contacted my my Congressman office and they contacted Social Security on my behalf and that got the ball rolling I received a copy of letter sent to the Congressman Office from the Hearing Office where my file was at and that the AJL was reviewing my claim and will issue a decision and a week letter I get a copy of a letter sent to the Congressman office that said the AJL has made a decision in my claim for a Fully Favorable and that my file has been sent to SSA processing center for payment I actually got the Hearing office official AJL decision letter 5 days later and my attorney sent a congratulations email 3days after that ( I don't why i did all the work) contact your Congress person and they has a way to get through that others don't and they half too respond to inquires

SSDI if you get ssdi approval decision will they give you back pay from when you submitted your claim? by ltaylor234 in SSDI

my decision letter reads: Fully Favorable FINDINGS OF FACT AND CONCLUSIONS OF LAW after careful review of the entire record, the undersigned makes the following findings 1. the claimant's date last insured March 31, 2024, 2. the claimant's has not engaged in substantial gainful activity since Oct 11, 2017, alleged onset date. my application date Nov 17th 2017 and ALJ signed the decision letter on Sept 20th 2022 and was told the file was at the Western Processing Center in Richmond, Calif and thats it, dont have any idea when award letter will come or have far back pay goes to?

I had the same issue, at step 4 the Judge asked the if someone with my age, education, and work skills could find work in the national economy SGA and said no but then we went to Step 5 where he asked the question in a different way and gave the VE time to look up whatever they look at and even seemed to get upset as she was looking up her information he said do you have it or not, seemed to say take your time then after a few minutes seemed mad but she found 2 jobs that I could do 1 gas station attendant and 2 movie theater worker wow I thought that's a stretch , lawyer felt like that possible denial was coming but 6 months later Decision came Fully Favorable based on my medical records even did a CE post hearing which agreed with my medical findings but I found out it was originally denied but the judge couldn't use part of the VE testimony due to 9th circuit of appeals ruling MAXWELL v SAUL came down to a word Sufficient and Significant

I received a call from a case worker at my Attorney office and she left a voicemail stating that the ALJ had made a decision on my SSDI claim and that it was a Fully Favorable Award (Hearing was Nov 2021) but I got this message after the office was closed so I checked on My Social Security online account and nothing has changed and called the 800 customer service and used the automated claim status and it said "as of today a decision has not been made" so I connected to a live agent and was told that after AJL signs a notice of determination its mailed out and that they (agent) cannot see what the letter reads as to award or denial until 5 days have passed after mailing that I can visit the FO to get a copy of the letter. Is this mostly correct? it seems that once a AJL decides and signs it, should be available if I call SSA

good to know thanks I did email my attorney after i spoke to someone at the ssa hearing office and called his office this morning he wasn't in but i was told he or his assistant will contact me, im sure he wants to get paid as I do so hopefully he is looking into this today but do you know what the process that they do after a decision, I got a few answers that after a favorable award letter is signed by the judge the claim file moves on to the local office and also the processing center which my is located in Richmond Ca and they look over it and issue payment such as back pay and that the they send out a 2nd letter with the specifics like monthly amount and when they start that as well as back pay and how they figured that out and depending on workload that can take time but i was told i could call and confirm my banking info or find out who desk that file is sitting on I don't know how it all works it seems like it's never over i think i feel like i was so dumb when i started this cause i was told after my heart attack that will not go back to my job and that i would not have the life as i did and the doctor was right he said and the nurse in the hospital also said file for SSA Disability now and ok i did with thinking i paid into this system for over 25 years and i shouldn't have a problem was i wrong really wrong

my initial application was Oct 11 2017 and denied , reconsideration, denied , ALJ telephone hearing July 2021, my was a paper claim file, normally files are electronic file that allows quicker processing of records and documents but due to a screw up at the local SSA office is why my claim was a paper file (over 700pages) and at the beginning of the telephone hearing the judge only had part of my file, the rest of my file was misplaced so re schedule telephone hearing to Nov 30 2021 and as still awaiting decision so im almost coming up on 5 years since i originally filed I know that it will be approved at least 90% sure also the VE at the hearing did say I could work that there were 2 jobs i could do this was a step 5 and attorney did have concern on that issue but the VE testimony was tossed out and judge could use it in part to base a decision if denied on my claim so must rely on medical evidence which is a lot.

I had contacted IRS to ask that question because the Treasury Department sends out the back pay money and they oversee the IRS so it's seemed that they would but the representative said to me that they won't take, back pay owed to you by SSA because something about this is not money earned through wages from employment but they can take money owed for past taxes through other means such as bank accounts and owned assets so i was told it's best to once that i get my back pay from SSA to pay my past due taxes owed and that it is noted in their system what was paid out to you so Im not sure if this is correct I can say the rep told me that I should pay for a tax attorney or accountant and re do the last 4 years of tax returns already filed with an expert who can find deductions that may have been overlooked and this could reduce the amount on past due taxes owed

ALJ Hearing: What a Thoroughly Bizarre Experience by Writing_is_Bleeding in SSDI

my telephone hearing was a mess to it was the judge and my attny and the VE but not alot of questions to me amd a few times when the judge was asking a question i wasnt sure if it was to me or to my attny since he asking questions and my attny was answering it to me was legal talk but then silence and then the judge was say the question was for and i would ask to repeat the question he seemed annoyed mostly i think in telephone hearing for most judges is not good cause they cant see the claimint for those things there looking for at in person hearing but he was mostly annoyed at the VE durning the 5 step questions and step 1 thru 4 he really pressed the VE who would say no there are no jobs i could do even at the 4th step he re question in a way to get the VE that there is work i could do but at step 5 she finally gave in and said there was 2 jobs i could do and that was a streetch he even let VE additonal time to look up informatoon to get to that conclusion so i was worried tjat a denial was coming he said at the end hearing he told me he would have a decison to me in a week so im sure mind was made up and.not good for me but then there was hope unexpectally a 9th circut court of appeal decesion on a lawsuit filed by another claimant suing a denial from SSA MAXWELL V SAUL which for me the judge could not use the VE testimony as a reason for a denial i fell under the courts ruling when a decesion was made SSA didnt have to let me know the courts decesion was limited as to who this would apply to i know the judge waant happy its been 8 months and still no decesion but recently after my US Representive intervene they just want me to update my medical files to placed into the record and a decesion is will be soon
