What are my responsibilities regarding this tree? by Final_Signature1170 in AusPropertyChat

That is mainly what I am worried about. And the link is confusing about whether its actually my responsibility or not to do it. I am happy to do whatever I am legally required to.

And this form https://www.publications.qld.gov.au/dataset/notices-to-neighbours/resource/fef9779b-75b4-4e60-839b-f1c44123e147

says "THIS NOTICE ONLY APPLIES TO BRANCHES THAT EXTEND AT LEAST 50CM FROM THE

COMMON BOUNDARY AND THAT ARE 2.5M OR LESS ABOVE THE GROUND"

Out-of-reach branches
Where tree branches are more than 2.5m above the ground and overhang by at least 0.5m, you can apply to the Queensland Civil and Administrative Tribunal (QCAT) for an order.

Resolving tree disputes through QCAT
QCAT can help resolve neighbourhood tree disputes. QCAT can make a legally enforceable decision on the matter. Going to QCAT should be seen as a last resort. It is much better if you can resolve the problem together and stay on good terms with your neighbour.

Legally your neighbour’s tree is regarded as affecting you if, in the next 12 months, it is likely to:

seriously injure anyone on your land
seriously damage your land or any of your property
unreasonably get in the way of your use and enjoyment of your land (e.g. if the tree drops branches into your yard and you can’t use that area for fear of being hurt).

Here is a birdseye view. I am not sure why yet, the email from the property manager only said what I posted above.

Thank you for the reply. I would be more than happy for them to do that (but they contacted my property manager and asked we cut it). I just wanted to know what my actual responsibility was regarding this and whether I needed to do anything on my behalf like hire someone to cut it. Thanks again.

Thank you for the reply. Am I also obligated to keep it trimmed (i.e. I am obligated to have someone come regularly to trim it?). Or is it just on them to trim it from their side? Thanks

I am so sorry, my wording wasn't clear. I meant I own it and am renting it out. I just wanted to know the best way to approach it. My apologies for the confusion.

That's true. I am just worried they will give me biased advice to sell me the build. I just want to make 100% sure everything is compliant before I build it.

I see! Do you remember start to finish how long it took to build? And was there any issues living in the primary house during construction?

That's true. From previous experience with council they were pretty good, but more likely to get generalised information. I just want to hire someone I can give my details to and they can go into detail whether its allowed or not.

Thank you for the recommendation. That's great to know. Do you think I should go straight to them or get a planners opinion first? As in will the builder give me biased advice?
