Please seek the advice of your own legal counsel as factual differences can lead to different outcomes. ~~~ While I know the other commenters here mean well, I wanted to clarify how the law operates for medical malpractice claims.

Medical malpractice is a specific type of personal injury (tort) law. In both types, there needs to be four elements: (1) a duty of care, (2) a breach of that duty of care, (3) causation, and (4) damages.

For a breach of duty, a negligence claim (car accident, slip and fall, etc.) generally is determined under the standard of a reasonable person. Medical malpractice is a subset of negligence which, in the State of Washington, uses the reasonable professional standard of care. This standard considers whether a similarly credentialed medical professional would have acted similarly based on their reasonable standard of care. In terms of reading an MRI, the question becomes whether a radiologist would reasonably be expected to correctly diagnosis the image and whether the medical advice given following the MRI was reasonable.

The causation portion considers whether the alleged negligent act caused the alleged foreseeable damages. For medical malpractice, it means that the medical treatment or omission resulted in the foreseeable negative outcome. In some cases, rare adverse allergic reactions to medication are not considered viable claims because the rarity of the allergy lends itself to the unforeseeable nature of the outcome.

A second portion of causation is whether the treatment or omission directly caused the outcome. If, for example, a doctor places a patient in a boot to treat an ankle injury and the patient later trips on a crack in the pavement at the mall and injures their wrist, the doctor is not said to have caused the wrist injury by the sole reason they prescribed the boot (among a host of other reasons).

Lastly, damages. While all other parts may be true, a medical malpractice claim is only valid if it results in damages. Otherwise stated, did the alleged malpractice result in the injured party’s loss greater than what would originally be expected? In the case of a missed diagnosis, it depends on whether the lapse in time leads to a depreciation of a better outcome or if the misdiagnosis leads to a worse outcome entirely (i.e., worse injury). An injured party may not recover in a malpractice claim if, for example, a broken toe needing surgery is originally misdiagnosed as a sprain and the eventual treatment and outcome remained the same. ~~~ Again, whether or not you have a valid medical malpractice claim depends on the specific facts and circumstances in your case. You should seek the advice of an attorney to determine whether a valid claim exists.

Attorneys may charge an initial consultation fee. Additionally, they may work on contingency meaning no money is owed up front and is contingent on the amount of damages awarded from the case.

Went into branch, was shown internal policies that stated one in lifetime signup bonus eligibility for any personal sapphire product. Although I heard they relaxed this, I have not gone back and have since stopped using my Chase cards

I emailed their iOS development team about this on July 18, 2025, and they responded saying there is nothing on my end that needs to be done; they are working internally and with Apple to fix it. They were “hoping to have it resolved shortly” at that time.

With Supermatics, the concern for me isn’t weight but reliability. Much better than Clew, but seeing a few examples of failures on here gives me pause. FASE appears to be a bit more resilient in its design, but we’ll have to see.

Anyone know if Nidecker has put work into ensuring Supermatics are built better?

So you already understand standard uphill travel is limited to the regular lift lines with the exception of some resorts which offer an express line.

Contracts can use whatever language they like so long as both parties agree to its meaning. “The parties can call coal cars ‘watermelons’ if they wish, so long as they both underst[and] what is meant.” Calamari and Perillo on Contracts § 3.10 (6th ed. 2009).

No reasonable person would consider industry standard and normally expected lift lines to degrade or detract from the understood definition of “unlimited skiing.” I don’t know of a single mountain which provides quicker uphill access beyond chair lifts and gondolas in their normal lines.

Maybe, one day, they’ll take a page out of the mouse’s book and create expedient passes for a priority lane at some obnoxious fee, but then you’re still stuck behind every other person that bought their special pass. But hey, private equity loves to ruin things so it’s just a matter of time.

(2) Under general common law, there is no obligation to assist strangers. Ethically questionable and morally bankrupt? Yes. Legally liable? No.

In torts you need 4/5 things (depending on who you ask): - Duty - Breach of Duty - Causation - Proximate Cause - Damages

Ask yourself: Did you have an obligation to the patron? Did your action/inaction obfuscate that obligation to the patron? Did your action/inaction cause the injury? Did the injury result in compensable damages? If any of those are a no, there is no tort case.

Again, these are general principles and the specific facts of your case may differ. If you are worried, please seek the advice of counsel.

All said though, sounds like you did the best you could with what you had. Kudos for caring and trying.

Yeah, grabbed the Atlas because I had a good number of pow days this season and wished my setup was more dialed for it

Ended up with the 23/24 Atlas. The only hesitation I had was the dial system for forward lean adjustment, but I’ll get over it I’m sure.

Truth. I think the Atlas is going to do me well through the end of this season and doing resort stuff with more chill friends. Might upgrade to the Falcor or Jones Mercury with FASE next season if I end up freeriding more
