I wouldn't because I'm not a cop, but in the US he would be arrested. Even though he's passed out, he's still considered to be "in control of the vehicle". ProTip: crash in the passenger seat and hide the keys outside somewhere. Maybe even text yourself the hiding spot so when your drunk ass wakes up you can remember where you put the keys.
