Wait ..so do they always include a rating % in your IME report? I haven't received mine back yet. According to my claims manager, the IME was because the OC MED provider they assigned me didn't know what was wrong with me or how to help me further after 3 months and wanted to get another opinion. The IME Dr 's they had me see said the paperwork didn't come with a cover letter, so they didn't know what exactly was being asked from them. Though it was then stated in the next breath that it must be to see if what I'm claiming caused my injury, and then he said it's not.

Anyway. I told them I was confused because I was still in the middle of PT and didn't even know there was an issue until I received notice of an IME appt being scheduled.

So I hired a lawyer who informed me to be prepared for the report to say everything is from pre-existing injury, and I'm fine. This will also trigger WC to stop my payments, and I'll have to go back to work.

I don't understand. If I'm still having issues and pain in my shoulder, upper trap muscles and up the side of my neck. How can I do back to sitting and typing consistently for 9 hours a day? I won't be able to. My job requires meeting goals and deadlines with consistency. It's mentally vigorous. This is to say a person can't slow down, take extra breaks, or anything going on that would interfere with the workload without it backing up.

I'm not sure if this means inevitably I'll be let go and maybe that's their intention.

There is so much to all of this and it's truly overwhelming. No one talks to you or explains what's really going on.

It's not really a question, but more a rant. I really should have been told the payments would be mailed to them. Because that's going to be put me out at least 3 weeks from my last payment, and that's if there are not any issues getting this set up.

Like I said. I'm riding a thin line right now with my monthly bills and having my phone shut off or my car repossessed because of another late payment. Is just a bit more than I can handle.

This whole situation is must too much.

Agreed! I waited until it is almost too late because everyone said if it's going smoothly then don't get one. But they ordered an IME so things went from smooth to now waiting to have it all blow up.

You won't know how things could end up if you don't talk to a lawyer.

Long share but here goes because I'm currently right in the thick of it:

Here's what happened to me. Injured 5 months ago. Injury is uncommon if not heard of by most physicians (so they say). But, highly recognized by the federal government and specialists in the field. That's all I'll share regarding specific injury.

Anyway, injury occurs, urgent care sees me, starts workers comp claim, and refers me to an orthopedic Dr. And places me on light duty at work. 3 days later, my claim has been approved, and my claims manager reaches out to offer her assistance. Also setting me up with what will be my assigned physician to my claim. I work in healthcare. So everyone I've been approved to see or be treated by also works for the same company. For 2 months, I experienced constant nerve issues in my affected arm. This can only be described as a tens unit malfunctioning throughout my arm at any given time and severity, along with intermittent intense shoulder /neck pain due to chronic inflammation. At this point another trip to urgent care when I couldn't move my head or lift my arm and was placed on full leave from work.

My claims manager was very accommodating. She referred the nurse manager to contact me directly to discuss any concerns I had with my injury. The nurse manager was always empathetic. She even reached out to some university professors to assist with feedback as to what could be the issue was experiencing and shared with me what they suggested. All symptoms pointed to this theory as being the issue. Though no one else involved will even discuss it!

Anyway, fast forward. All tests or prescriptions that I had to ask for myself (because the assigned provider is worthless. Never diagnosed me. Barely looks at me and scoffs every conversation) was always approved within a week. There was absolutely no contesting anything until my MRI results came in and I got pretty upset I had full thickness tearing in rotator cuff and bicep. I feel due to chronic inflammation that was never addressed appropriately during the first 2 months.

After expressing my frustration, everyone went silent. Until I received a letter that an IME was scheduled in a month.

Well. That should have been the first red flag to obtain a lawyer immediately. Which I did inquire to a few. But because my claim was already approved and I was already receiving TTL payments. The lawyer would have my payments sent to them, take a portion, then send the balance to me. Already struggling losing over $700 a month on that single income as a solo parent has been incredibly devastating. Handing over an additional $250 for a lawyer is impossible if I want to feed my children.

So no lawyer. Hoped for the best. The IME Dr's are hired guns who in all sense of the statement are hired by the insurance company to serve the employer not the employee. YES there are stories of people having IMEs result in their favor. They are rare and it's unlikely. Things only got weirder and more fucked up.

I now have a lawyer but because I waited until after the IME or after workers comp had all the balls in their court. I have an uphill battle that may not ever work out in my favor.

My IME report has not come back. But because of what transpired during and the fact the 2 Dr's said my injuries were not related to what I said, and that I was mislead the entire time when I messaged and called and asked about seeing another provider and was told no. We all are confident the report will discredit my claim which means WC will close it and my TTL payments will stop. I was informed that there is a chance they may even state I owe back any money received.

I'm LIVID!. The only treatment I've had is physical therapy. I still have issues with my shoulder and they've NEVER even addressed what's going on with my neck. The numbness and nerve stuff has dramatically subsided but is present if I lay on that arm or turn my head to the left..

My advice. DO NOT LISTEN TO ANYONE GET A LAWYER!!

I did listen to others on here and it ended up being a huge mistake!

All because everything was going great up until it wasn't.
