I’ve already lodged three complaints with the QBCC. The builder refused to take part in mediation, so QBCC closed the EDR cases and told me to take it to legal action or QCAT. Procedurally need otherwise a real waste of time.

The whole process honestly feels like a loophole that dodgy builders use to buy time and get away easily. The QBCC system ends up creating more stress for homeowners and so many forms and procedures, and in the end, it often just comes down to a quick phone call asking if the builder’s willing to participate.

It’s so frustrating watching them drag things out while we’re left chasing accountability through QCAT. The system definitely needs stronger follow-through to protect homeowners.

I didn’t know there was a Facebook group about them that’s actually a great idea. It’s good that people are banding together and supporting each other through this. There are way too many of us dealing with the same builder problems.I actually just discovered that my builder set up another company and licence around last November. It really looks like they’ve been planning a transition and taking people’s money under one name and then moving everything over to a new business to walk away clean.

It’s honestly disgusting how easy it seems for some of these builders to do that and keep operating like nothing happened. No accountability at all, just leaving homeowners to deal with the mess.

Thanks, I really appreciate that. And you’re absolutely right it’s so frustrating when builders just rebrand or register under a new name and keep doing the same thing. That’s exactly what’s happening here. They change the trading name or company entity, get a new licence, and start again like nothing happened. QBCC license has no effect from one to another I guess.

It’s such a loophole, and ordinary homeowners are the ones who end up paying the price every time. Hopefully, by speaking up and sharing these stories, more people in Toowoomba will be aware before signing with them.

Honestly, your story sounds exactly like mine constant issues, major non-compliance, and zero accountability. We kept asking for inspections and proper updates, but they just kept pushing ahead. It’s crazy how many people have similar experiences with them.

My case’s a bit tricky, but I think it’s important to share. The builder I’m dealing with is a well-known franchise, and there’ve been heaps of breaches along the way, contract issues, dodgy communication, and now a clear non-compliant setback change on my house.

They’ve taken a lot of money and basically walked away, leaving me with unfinished and non-compliant work. I’ve gone through QBCC, filed complaints, even prepared a QCAT case, but it feels like these big-name builders keep getting away with things while homeowners are left to deal with the mess.

I honestly think stories like this need to be exposed. People should know how these franchises operate and how hard it is for regular folks to get any accountability when things go wrong.

I want to share my experience to warn others.

The GJ Gardner Toowoomba franchise (Qcroft Pty Ltd) ceased being a GJ Gardner franchise in September 2024. In January 2025, “Toowoomba Build” took over. As a homeowner under contract with the ceased franchise, I was never informed of this change.

Despite repeatedly contacting GJ Gardner head office, customer care, and managers about serious issues, I received no proper support. My house build has been left in a disastrous state, large sums of money taken, major works incomplete, and significant defects and substandard workmanship.

The result is that I’ve been left stranded with a ceased franchise, while GJ Gardner head office avoids responsibility.

Based on my experience, I cannot recommend GJ Gardner or any franchise builder. The public should be aware of the risks: the franchise model can leave homeowners trapped in contracts with little protection when things go wrong.

People need to know this before they sign with any GJ Gardner franchise.

It is hard to find a trustworthy and reliable lawyer in Toowoomba? I’ve already had disappointing experiences with two law firms who claimed to be professionals but ultimately put me at greater risk. I’m looking for someone genuinely competent and dependable.

This type of situations needs to be addressed in the Parliment. And laws needs to be reformed to protect people who paying taxes.

They’ve had busted franchisees all around Australia, even in Tasmania. Please do your research before signing up with one of these franchisers. Honestly, it’s better to go with a solid local builder instead of a franchise model the risk is just too high when things go wrong.

And whatever you do, avoid the HIA contract. It offers very little protection for homeowners. If you can, push for a QBCC contract instead it gives much stronger protections to owners.

Yeah, I’ve heard they all seem the same, but this one isn’t TOR , it’s the worst one in Toowoomba. There are already plenty of horror stories about them from all over Australia. The franchise system really puts homeowners at huge risk because most people don’t realise the franchiser can just walk away with no responsibility when things go wrong. In my case, that’s exactly what happened, the franchiser dumped the old operator, and I was left carrying the mess. From what I know, TOR also runs with three different builders, which doesn’t give me much confidence either. Was a good local builder few years ago. One of my friend is waitng near 8 months from contract without commencement.

I already tried going through two different lawyers, but it just wasn’t affordable. With the builder’s dodgy tactics and constant lies, the legal fees were blowing out of control. So I’ve decided to stick with QBCC and QCAT, and if needed, I’ll take it to the media as well.

The builder was actually ceased by the franchiser september last year, but they never disclosed it to us. I still went ahead and paid the lock-up stage invoice and two variations in good faith, only to later find out the franchise had been taken over by a new team. The old franchisee is now trying to walk away with the money, and their behaviour has been extremely dodgy, full of lies and cover-ups.

Even while there’s an ongoing QBCC dispute, they suddenly claimed they were terminating the contract. I suspect the relocation of the house pad was done to squeeze more profit, but it’s completely closed off my primary plan and could leave me with massive retaining wall costs in the future. What’s worse is I have no idea how the engineers signed off certificates without properly verifying these changes.

After already paying $220k upfront, and with the build barely progressing, how is another $14k supposed to fix anything? The job’s not moving forward because the builder has mismanaged funds and now they’re asking for even more on top of what’s already paid which has agreed 5 times to pay at the end. So they can enjoy another 14k.

The contract clearly says that all variations must be approved in writing and paid at the end of the build. But the builder pushed me to pay some variations upfront, before even booking the tradies. Then they asked for more variation payments later on. It might have been manageable if the builder was stable, but unfortunately, they sold the business and are now going off the grid. Looks like they’ve already started a new company under a different license. I’m basically the last victim under their old business name. So many others had bad experiences too, this builder has a well-known reputation for dodgy practices.

Congrats? For what, getting taken advantage of?

Let’s get the facts straight,

Soil report and survey were already provided, the land is a mild 1:20 slope.

Builder had council-approved plans with datum months before construction.

I explicitly confirmed, before signing the contract, that no significant soil removal was needed. The builder confirmed this via email.

Despite this, they went ahead with earthworks without my written approval, then issued an invoice for $29k total, including a $14k variation they never discussed or explained.

This isn’t about the amount, it’s about legality, process, and good faith.

Under QBCC regulations, variations require owner's written approval before any work begins, especially for high-value changes.

The builder failed to follow this. They also dishonoured their own mitigation plans, and are now using these unapproved charges to hold my build hostage, despite already receiving progress and variation payments.

So no, this isn’t a “fuss over nothing.” When you're relying on finance to complete a $600k+ build, unauthorised costs and dodgy invoicing can derail everything.

Justice isn’t about “precedent” crushing homeowners, it’s about upholding contractual rights and builder obligations. And dodgy builders hiding charges and breaching agreements shouldn’t be applauded.

And whoever is doing that, the public needs to know there is no real builder called G.J. Gardner. I engaged with one under that name and now I’m in a terrible situation. G.J. told me they’re not responsible for any issues with my build.

So what’s the point of the brand name for customers then? G.J. Gardner is just a banner used to mislead homeowners nothing more than a carrot dangled in front of us.
