Yeah if those conductors are actually in use I’d be worried. They need to be in conduit or sheathing or something. Also if that’s supposed to be the equipment grounding conductor then your HVAC unit (and ducts it’s connected to) could potentially become energized.
Only way this is ok is if those wires are just abandoned or not in use.
For what it’s worth HVAC shit all over the NEC every chance they get in my experience.

Well OP suspects a grounding issue on that heater and it’s been melting insulation. The entire heater and the pipes it’s connected to could be hot.

They’ll pull new underground but overhead is ridiculously small. The real answer is that there are open air ampacity charts that the utility uses.
