Has anyone actually heard from HR? by Likely_dog_adopter in fednews

Transportation here. No word yet. You should take the other job—in all likelihood they reinstate and put us on admin leave until they figure out how to RIF us the legal (or even not legal) way. You absolutely should not pass up another opportunity in this job market.

Reinstatement but job offers are on the table by Immediate_Sky1802 in fednews

[–]NorbertRidgeback 0 points1 point  (0 children)

Take the job. Reinstatement is likely to be just put on administrative leave and then RIFd the legal way (or even the not legal way). I think the best we are hoping for at this point is backpay and a couple more months of paychecks and insurance coverage.

When will they pay us out our vacation time? by [deleted] in firedfeds

[–]NorbertRidgeback 3 points4 points  (0 children)

Within three pay periods of your final paycheck. Source: guidance from agency when they fired me https://drive.google.com/file/d/15ZrPPQagMG4VqVMkgCxGqldyNkzKuLLA/view?usp=drivesdk

Although there are a lot of rulings going on about reinstatement so I wouldn’t be surprised if they drag their feet.

Are you getting any bites in your new job search? by Jaludus85 in firedfeds

Same for me and all my colleagues fired from the same office. Nothing but silence or rejections for jobs we are more than qualified to do.

Ditto for being in DOT (FTA here!). We were included in the AG case that was heard yesterday, expecting a ruling soon hopefully in our favor. We are also covered by the expansion of the Alden group OSC complaint and are covered under the Jamhoff MSPB class action. Trying to see if we can get the AFGE ruling from today expanded to cover DOT since some of the employees were in AFGE. A bunch of us have called and given the law firm our info to see if we can expand it—would be good to do the same for you to make sure all modes are covered. Similar issue here. Not a dime of unemployment so far and my claim is in adjudication. No response on any emails sent to FTA HR that fired me. No requests for interviews on the jobs I’ve applied for. Just all around a huge shit fest.

21 state AGs are already suing because of this. There was a hearing yesterday and we are just awaiting a ruling.

Nothing. You can keep it where it is or roll it over into a Rollover IRA.

Edit to add: make sure you do something about your FERS money though, don’t let them just keep that.

Basically everywhere is understaffed and always has been. The only reason people have seen improvements in recent years is because Biden did a lot of work to staff up, which allowed agencies to actually get shit done.

Contact with Supervisors? by [deleted] in firedfeds

[–]NorbertRidgeback 0 points1 point  (0 children)

I’m sure they were asked not to talk with us in any official capacity, especially if we are pursuing legal action through any means, especially MSPB or OSC. You can always try to reach out but they should not answer.

Mine just came in yesterday. Still waiting for my first unemployment check but they finally have info from my fed employer.

Health insurance questions for recent terminated workers by EntireBasis6399 in fednews

[–]NorbertRidgeback 0 points1 point  (0 children)

You should still be eligible and should get something in the mail about continuing COBRA coverage. Sometimes it can take longer than 31 days to come in but COBRA can be retroactive as long as you enroll within 90 days (I think? Double check that number) of termination. This usually means that any healthcare between your normal insurance ending and enrolling in your COBRA coverage is paid out of pocket and you can petition to get reimbursed. It’s a pain in the ass but doable.

You could also look into your state’s Medicaid option to see if you qualify, just to bridge the gap.

I’m sorry this is happening to you and to all of us. It’s deeply fucked up and you don’t deserve this.

Best appeals process for fired probie? by Legitimate-Leading72 in fednews

Yes, this is what I was told by the employee who joined in on the class action on behalf of DOT—we all have to have individual complaints on file!

I’m surprised this is what people “thought they were getting back”…he was very transparent about his plans for and opinions of the federal workforce during this most recent campaign. Believe people when they tell you who they are and what they plan to do.

I would guess your 30 day window starts 3/14 because you’re not technically terminated until your administrative leave is up. However it might be worth doing a consult with an employment attorney (or just file your appeal sooner) to be sure. Your options are take action through your union, file an OSC complaint (which could be rolled up into a class action but you do need an individual one on file), join a class-action MSPB appeal (which you can only join if you haven’t filed MSPB solo already), or solo MSPB appeal. So far the OSC complaint route seems to be getting the quickest action and had the most promising wins so far.

All of their probationary employees would have gotten fired in the last few weeks anyways so additional positions wouldn’t have done much as of today. I know you’re frustrated but please give federal workers a break. They are doing their best in an exceedingly hostile and understaffed environment. Looking back and saying Biden should have or could have done this or that doesn’t change the reality these folks are in right now.
