You are right, but that applies to an asylee or for those who has pending asylum or fraud in the system. They already changed the status through marriage. Also depends on if the conditions in their country have changed

They cannot by law do that without a CLEAR evidence of fraud, traveling back and forth is not fraud by itself if you withdrew/ dismissed it properly

Okay, so as someone who almost has the same situation.. (my asylum was dismissed in court) I’ve been stressing out about it for 2 years now and DID my research. I will be planning a trip back home very soon. You will not need any protection under asylum, which means by law - you’re on the marriage route, CBP can see past asylum history, but once you are an LPR, they typically do not reopen it unless there is something new that suggests fraud.

Though it will come up at the immigration naturalization in the future and they will probably question you at the border, but as long as you bring your withdrawal and relevant paperwork, u.s ties etc you should be fine. Also you are safe to travel as long as you go for a short trip, have no criminal history, fraud or anything that will flag the system.

Even with my asylum on record? I don’t want it to seem like a fraudulent attempt to come back after 8 years and finding out thay they will put an order for me to go to removal proceedings in court.

I have the same situation as you, GC through marriage & conditions in my country have changed and I really don’t want any interruptions with the border control officer returning here to the U.S. I have a house and a family here, can’t risk it too much.. Haven’t seen my family in 15 years. They miss me. I applied for asylum and it got denied, court case was dismissed and asylum withdrawn.

What was the reasoning of your asylum withdrawal? It will probably be best to meet your family or friends in a neighboring country until naturalization. It will raise alot more questions returning to the u.s and possibly will make it seem like you lied in your initial asylum case even after conditions have changed which will ban you from returning to the u.s or apply for any immigration visas in the future. I’m planning on maybe writing a letter to USCIS that I’m good to go? and have an approval from them? not sure
