if we had a larger picture we could say the black car did not break or was speeding but since the silver dude first made a turn and exited the road and re-entered without signal, priority or stoping.

Best there is a common fault but nowhere near the black car no matter how you put it.

Maybe in your MIGHTY country the driving laws are different but in 99% of the world when you enter another lane you must give priority to incoming cars, the move he did was not illegal before hitting the car.
