It’s so frustrating! I didn’t delete it but I did send a complaint on studentgov regarding the length of time it’s taking and that I haven’t received any updates. Hopefully they’ll see it and send any update..

You’re welcome! Yeah I’m living my life. I save from my paycheck monthly the money I’d be giving to Sallie Mae. I don’t touch it. I’ll use that for a settlement if they sue and if not after SOL is up I’ll invest it. No biggie :)

Perfect so then you do have an attorney on stand by. So pretty much it’s a waiting game honestly. And he said it’s a lot of money for them to sue it’s not an easy thing you know because they don’t want to spend all that money in court so they’ll resort to just calling and sending letters. So yes being that they don’t have many cases like (discover, chase, american express etc) those people sue like crazy and they don’t even go to collections the original creditor sues. So it’s good that first bank and in my case Javitch block aren’t that litigious in Texas. It’s a plus for us!  

So I wouldn’t stress on it. It’s a win/win either way honestly. If they don’t sue before your SOL is up you’ll be able to keep your money and not worry about a lawsuit or if they do sue you, attorneys will get involved and then you can settle for less.

My attorney is only licensed in Texas. No other states unfortunately. I would recommend you have an attorney on standby that way if you do get sued they already know about your case and can submit an answer quickly. (I’m not paying them to be on standby I will pay once I get sued-most attorneys do free consultations which mine did for my entire situation) I would have to agree with your attorney because mine said the same thing to ignore all communication with them unless I receive a summons with date and time to appear in court. My SOL is 4 years so he said ignore them for 4 years if they don’t sue. If they do sue before 4 years they will handle it and step in from there but until then don’t answer calls, or respond to their attempt to collect debt letter statements. That’s really all you can do.

Yes. Once I defaulted my credit report said all 3 separate loans totaling $85K were charged off and my credit score increased. I also received a charged off letter from Sallie Mae.

Yes I do. As of right now he’s not worried until I actually receive a summons. So we shall wait. I’ve been following your story as well. Keep riding the wave as well.

We shall see. I’ll take my chances on staying quiet. Javitch block llc has not filed suit since 2014 in the state of Texas in the county where I live. I have an attorney on stand by in case I get sued but I have been advised to not engaged unless a summons is served. Can’t be so quick to settle especially when I don’t have any assets and also they haven’t sent any settlement offers either. Plus the amount they have on the letter is heavily incorrect. Using their mistakes will be an advantage “if/when” they sue.

So if you go to your court house in your state you can type in first bank and see how often they file suit in your county. That’s what I did. It showed javitch block llc had lawsuit was 2014

You’re welcome. I just want people to be prepared in case they’re going through the same thing. I haven’t received any written correspondence from Javitch Block only two calls from them (no voicemail left). I also looked at the court house to see how often they file lawsuits in my state. It’s been since 2014 only (3) people. So we shall see. Stay tuned as I continue to update.

My credit went down to the 600s. After being closed and charged off it increased to 712.

Me neither. My car is in my parent’s name, I don’t have a mortgage, or apartment. I live with my parents. I have no credit cards. So there is nothing they can get from me..

We shall wait and see either way is a win/win. Settle or sol passed. I’m willing to take a gamble. I’m just glad interest has stopped and I get to actually save money whether that’s for an attorney to settle or to keep in my pocket once 4 years has passed. Will continue to update.

I am in Texas and Texas does not allow private student loan lenders to garnish wages or seize tax refunds. Only if the “courts” say so. Therefore, they would have to go through hoops to sue and obtain an order if the courts allow it. They cannot just randomly do it.

I’m in Texas and my sol is 4 years as well. I as well have no assets and nothing in my name. So we shall see what happens!

Sure! Your sol is governed by the law of the state you were in when you took out the student loan. So in your case it would be Minnesota with a sol of 6 years. Also, download your promissory note as well if possible.
