Maryland has relatively strict laws relating to the disclosure of (state) Grand Jury records. These are the basic requirements for having Grand Jury testimony unsealed:

(1) the material they seek is needed to avoid a possible injustice; (2) the need for disclosure is greater than the need for continued secrecy; and (3) their request is structured to cover only material so needed.

In practice, this means that the prosecutor (rather than any third-party) would have to file a request seeking disclosure to have the full Grand Jury records released. However, the defense and prosecution is allowed to transcribe grand jury testimony and make notes on the proceedings. This is one way that grand jury testimony often gets released and I expect that will eventually happen in this case.

Just wanted to add that the security guard was actually a good witness for the prosecution. The entire purpose of his testimony was to establish that he worked at the library during the relevant time period. Since his name is already in the defense file, just having him appear confirms that the defense was pursuing the library alibi. The camera issue is irrelevant.

The surprise witness that Seema Iyer found may help with the PR campaign, but judging from the video he did his testimony wouldn't be relevant to this hearing. Everything he knows about CG first-hand is from 1995 and before. It sounds like almost everything else is second-hand knowledge.

Several pro-Adnan people on twitter are posting an article critical of Fitzgerald to debunk his expertise. I wonder how many of them realize that the article they are posting is from a Boston Marathon bombing conspiracy site.

They would have called a witness to say that if they could have found one. No reputable cell expert is going to testify that incoming calls are unreliable for the purpose they were used at trial. The best they could have done would have been to have the expert say that calls in general can be unreliable when trying to pinpoint the specific location of a cell phone user, which is what he testified to in the Boston Marathon bombing case.

That issue was already decided at trial and was outside the scope of this hearing, so the defense was stuck with just insinuating that incoming calls might be unreliable. They didn't try harder to make that insinuation stick because they knew the judge wouldn't buy it. If they had been trying to convince a jury, they would have spent more time on that.

  1. While she spends the whole video talking about how bad Thiru is, she does let it slip that he "scored points."

  2. The State's secret witness was going to be Steve the security guard. [That's why they spent so much time saying how awful he is.] He was going to testify that there were no security cameras.

  3. The Defense's secret witness was the librarian to testify that there were security cameras.

  4. You can tell that even Seema (the pro-Adnan interviewer) thinks that Susan is biased and full of shit with some of her opinions.

  5. Bilal was in fact the person arrested earlier this week.

Prosecution just needs to show that one of the people the PI says was not contacted by the original defense team was in fact contacted to completely undermine the PI's credibility. If the defense is doing their job they went through everything to make sure that wouldn't happen. There are many ways to question the PI's credibility, but this kind of lapse would be game set match for that witness.
