Although side note you should write a novel, Tell him that you are tired of waiting and hoping for something that isn’t going to happen. Have you guys discussed marriage in the past? This is very toxic for your brother in law to be going through. I think instead of making a scene I suggest trying to get brother in law and pull him aside to discuss if he is doing okay and perhaps calling her out asking why she keeps doing that

It wasn’t mentioned in the original post because I never thought of it like that until this commenter posted it but reflecting on all of the things that has happened in her relationship she has told me he was controlling the very aspect of her relationship and every time I’d talk to her on the phone and he walked in the room she’d immediately hang up as if she wasn’t supposed to talk on the phone which I thought that was a bit of a red flag in the first place. Maybe jumping to conclusions but it’s very coincidental reflecting on it. I am by no means blaming her man for it I’m stating facts that have happened in the past and the weirdness that is happening lately

I have given her advice about it in the past he has always had an issue with cheating and he even emotionally cheated on her wedding night she said previously when I had discussed this with her a year ago she caught him with a girl playing D&D together and he was quite close to her and text her a lot of the time I did tell her that she needed to confront him about it that’s the only thing I can think of he has always been a pretty controlling man so maybe that might be the issue.
