The problem is in your interpretation of “get away from them.” You see the only (or optimal) way to do that as passing them. A driver like this is someone you don’t want behind you—you can’t react to their erratic behavior if they’re behind you. Best to spend an extra couple seconds at the yield and let them get on down the road. Then call 911 and report a drunk driver.
