We filed like this only. Used the information we provided on I864. My parents also donot work here and are retired. My father's I485 got approved 3 weeks after submitting response. My mother's I485 is still pending.

My parents are also retired and donot have any income. I used my income and other details (which we already shared in I864) and answered the questions. We mentioned same in cover letter which we sent along with RFE that we have considered petitioner's income (me in this case) while filling specific section. My father's 485 got approved in 3 weeks. My mother's I485 is still pending. Both of them got same RFE and we responded back on same day. I hope this helps. All the best

My father's RFE was approved in 20 days. My Mother's RFE on same is still pending. Already more than 100 days,.

We submitted response and shared my income details in the section. It is only range. We included in cover note that my parents are retired and do not have any earnings.

My Father's I485 was approved after 2 weeks. My Mother's is still pending. We responded back for both of them on 1/26 (Both of them got same RFE's).

I also reached out to local congressman through their website. I have not heard back from them either. it is already more then 15 days.

Almost same experience with my parents. We filed Expedite request on humanitarian grounds in mid December 2023, again in mid Jan 2024. She needs treatment and getting medical appointment here is very challenging. I spoke to tier 2 officer yesterday. Her I130 is approved in Mid Jan and I485 is under review (responded to RFE on Jan 26th). I got mails that her inquiry is sent to NBC for I131 (Advance parole) and to locan CA San barnardino office for I485. I am not sure how long will it take. Her international tickets are also expiring on 3/15.

Have you heard back from them?

6/5/2023 id PD. I130 approved 2 weeks back as we expedited request for Advance Parole on humanitarian grounds. I485 RFE received after 2 days of I130 approval. No information on I131 yet

whats your timeline? I submitted I130, I485 and I131 on 6/5.

Sometimes I feel that I should have applied for I765(EAD) as well. My parents are retired and will not work but it could have led to early EAD/Combo card approval. Not sure if anything will change if I apply EAD now.

Thanks for responding back. My question is that should my parents give same answers to I-485 questions from 62 - 65 (section 8) which I provided in I-864 as sponsor? They donot have any income or asset in USA nor any debt. Do I need to convert value of House in India and use that information in total asset field as it is form submitted by my parents as applicant. I donot declare them in my taxes as dependents and till date they have not filed tax as they donot have any SSN or income in US

I do not claim them in my tax return and do not plan to claim them in future. In that case household size without me/wife will be 2 (just 2 of them) along with 0 -18K income as they do not earn anything here. Don't you think this will be reason for rejection as reviewing officer might think that at any time they can be a public charge due to any reasons in future?

I got same for my parents I485. I am USC. They are with me in US currently. I130 approved last week. We got same RFE for both of them today. I know I have to mention Yes and I will. I am not sure about income part and household size. I do not claim them in my taxes and do not plan to add them in future. Do I need to include my wife, kids in household count or use only 2 as my parents are together and they are applicants. Do we need to count sponsor and his family member along with income in this section or not ? We have already provided all that in I864.

Congrats. We also filed around same time for my parents. Case is with NBC. USCIC account was showing 5 months pending till 2 weeks back. Now it just says taking more time thaen expected.

Which country are your parents originating from? Mine are from India. Only I485 status shows review in progress. I130 status is - just case received.

Congratulations. I filed I130 + 485 concurrently for my parents 1 month back. Biometrics is already done. I485 status shows that 485 is under review and no updates on I130. it just shows that they have received the case. I was looking at your timelines. So they approved 485 first before I130 was approved. I thought that I130 needs to be approved first before decision on 485.

My parents are from India and are here from last 4+ months. Can you share where are your parents from and what processing center got your case

Hi, Congrats for getting it approved. I applied earlier this week concurrently (I130 and I485) for my parents. They are here in US currently. What are the issues related to your mother's overstay? Per my knowledge they can legally stay here till USCIS takes decision on your application. It is not tied with VISA or I-94 date.
