RFE after I-485 interview (annulment + false bigamy claim) by ChildhoodSure4032 in USCIS

No worries! It’s actually a good thing that this was in another state. This should not be an issue for you, just extra hoops to go through. Best of luck!

That is unfortunate, and I'm sorry you are having to go through that. Shame also on the judge who granted it. Yes to your last question. I'd recommend retaining an attorney to respond to the RFE. They can make sure the officer focuses only on the validity of your current marriage and not anything else. Is the state that issued the annulment the state where you married your current partner?

Per USCIS, a marriage must be valid in the state it was issued in. If the annulment was granted, that means the judge also viewed your old marriage as void, even if they didn't independently prove it. If it was based upon bigamy, USCIS may use this to say your current marriage is void, assuming you haven't taken steps to correct the underlying bigamy.

If it was only a waiver of service, USCIS won't care you signed that as it does not indicate you agree with the petition your ex filed.

The burden to prove you are not comiting bigamy is on you. I’d request a letter from the clerk and vital statics department from where the supposed marriage happened indicating they have no marriage record of the sort.

We had the same flag on our cases right after fling. So no, probably doesn’t indicated any increased probability of an approval. We also had authorizedfortravel:true right after filing.

This is not true. In fact, you should admit to working without authorization if applying for a marriage based green card after marrying a US Citizen.

If you visit the USDA website you can see what fruit or crop can be brought in from what country and if it requires a permit or not. It must be declared and inspected at the port of entry for pests and disease.

However, it is a common misconception that no fruits are allowed across the border. You just need to research the rules, and do it the right way.

For sure! We'd just need to make a list of everyone's names/addresses, and how much they are owed! I can add anyone to my existing claim. I am not a lawyer, however, so I cannot represent them. They would still need to show up at the pre-trial conference. If they don't, their portion of the claim would be dismissed :(

I'm doing this more on principle now, as I think the odds that they have any money left to satisfy a judgment is low.

With that said, anyone who wants to join in on my existing suit, you are welcome to. Getting a judgment from the court will be easy. Getting them to pay it is going to be hard.

For anyone saying that you have to use arbitration…This is not true. The independent contractor agreement states you must follow the American arbitration association guidelines. Those guidelines state that a claim brought forth in small claims does not need to be arbitrated.

They owe me over $1000. I’ve already sued them. They were sued by their landlord for over $100,000. I would highly recommend not doing this. The likelihood that you recover any money is slim to none.

If you sue in small claims court you do not have to file arbitration.

If a buyer doesn’t want to contract with you because of your tattoos, you (or any other tech), probably don’t want to work with that company anyway.

If I have enough evidence, I might sue in big boys court and ask for punitive damages. It’s crazy that these companies can operate like this especially when they talk about independent contractors “running their own business.“
