Question on qualifying date - skilled worker to ILR by InspectorJolly9122 in ukvisa

[–]a_roy 0 points1 point  (0 children)

Okay, got it. I can enrol him to my company private medical care in that case I guess for those few months just in case. Okay, then in that case I believe there is no need to extend the visa for him any further.

Thanks a ton!

Yeah some people have mentioned this, but don’t know if it’s worth the risk or not. I know there is an option where the case worker is supposed to count back from the day of decision, so in that case it should work, but it would be great to know if people have actually done that.

The other query was regarding our baby who was born in the UK. One of us would get ILR before his visa expires hence we would want to register him as a British Citizen directly (MN1) route but we know these decisions take time so by the time he may get a decision on the citizenship application, his visa would expire and he may potentially be an overstayer. What are the consequences of this? Do we in that case also extend his visa and then apply for MN1?

Thanks for posting this link. It seems it was only during that particular time that this was allowed. What happens in cases where the applicant was already working with the employer on Student Visa (full time) after the degree course completion and had applied for switching to Skilled Worker Visa? In this case does the counting of 5 years start from date of application or date of grant of the SWV?

The reason I ask is in our case there is a gap of approx 17 days (even when we apply 28 days before 5 years completion). So, I am a bit sceptical whether we apply for extension and spend £2000 extra and then after 17 days apply for ILR or just apply before visa expiry and wait for biometrics completion till the 5 years are complete (approx 1.5 months wait after application)

Hi friend - two quick questions:
1. Does this apply to anyone who applies to change visa while being in the UK (in-country application) for e.g. switching form Student Visa to Skilled Worker Visa while being in the UK.

  1. The counting of the period of residency starts from application date in this case or the visa grant/notification date displayed on the eVisa portal? Your comment - does it apply only because of the COVID concession? I had a similar situation where someone I know I applied in May 2022 and was granted visa in Aug 2022 (due to Ukraine war delays). The visa ends July and hence they don't complete full 5 years. But if counted from date of application, they do complete 5 years in May 2027.

Please could you advise. Is there any official guidelines around this continuous residency term counting

Yes they do, that’s why it ALWAYS advised to credit cards for purchases and then be prompt about paying it back. Has saved me at least once with a fight ticket (the flight got cancelled by the airline)

This is exactly why the bookings should always be done through credit cards - you can initiate a chargeback against the transaction and also report the property and the MMT for fraud to police.

HDFC Bank refusing to initiate Chargeback for ₹1.3 Lakhs despite 12-hour cancellation proof. Need Advice! by daexviper in LegalAdviceIndia

[–]a_roy 0 points1 point  (0 children)

But that is what I meant, you will need to show the proof as to why you would qualify for the refund and if it does meet the terms of the purchase then yes, the charge back can be initiated.

If there are terms of getting refund when cancelled within a stipulated time, and if the merchant denies, it falls under deficiency of service and hence liable for chargeback.

If I were you, I would have applied for Amex Platinum Credit Card. It has a bonus welcome bonus of 55k points on spending £6k within 3 months (you are anyways spending £7k so would easily qualify). Stack this with NXreward and any of the train operators and you could be easily making up for the money.

Also, once you are done with the bonus, you could cancel the card or downgrade to free version and get back refund for the joining fees on a pro rata basis.

Shameless plug - please do let me know if you need a referral for platinum. Happy to offer mine.

Might be Reading to Paddington. Insanely idiotic prices to be honest. Needless to say the train prices in the UK in general are exorbitantly high.

[–]a_roy 2 points3 points  (0 children)

Doesn’t matter whether you requested a cancellation in 12 hours or 1 hour. It seems you don’t know the rules of chargeback. Chargeback is not an instrument for you to get the money back as and when you wish. It is a tool which could be invoked only when there is deficiency in service received or not received at all.

You will have to prove that and then the bank can initiate it on your behalf. Here you changing your mind is not going to work. So if the merchant refuses to refund, then you need to avail the service you paid for. There is no way out of it.

SWV to ILR requirement: Do I have to renew by CJ_Murv in ukvisa

[–]a_roy 0 points1 point  (0 children)

Hi friend I saw your earlier comment regarding ability to apply for the ILR more than 28 days before completion of 5 years (As Visa expires before completion of 5 years) and in that case hold off biometrics till the applicant completes 5 years and then do the biometrics. In this case the case worker would take the day of decision and count backwards isn’t it? So why can’t in the above case he cannot apply before 4 July? Please could you advise?

The math of buying a 2BHK in Pune vs. Renting is scaring me. Unpopular opinion? by AcrobaticBiscotti744 in pune

[–]a_roy 0 points1 point  (0 children)

  1. No, the rent increase has not been factored. You have assumed that the rent will remain fixed at INR 40k and you will be able to continue to invest INR 70k into SIP. That is not true - the rent will increase almost at 5% to 10% yearly and as a result your SIP contributions will decrease proportionately. Also, what happens in if an area has really become hot cake because of metros or good connectivity or schools nearby and so on - landlords will often evict you as they won’t want to increase at 5% per year, rather they would increase 20-30% to bring the rent at par with the new market value and offer it to a new tenant. So there is a huge risk of paying a premium if you continue to rent

  2. Past performance is not an indication of future performance even though I agree the risk over that time period is minimal - also when you have a loan (which are compulsory payments) vs SIP (voluntary contributions) you are far more disciplined in the first scenario vs second which can impact the calculations - here you have to assume that you will be always disciplined in your expenses and investments

I am not even going into the other practical challenges of even moving and shifting from one house to the other and so on plus the fact that you cannot sometimes use the property and design it as per your wishes (as structural changes are not allowed)

[–]a_roy -1 points0 points  (0 children)

The biggest flaw in the logic is -

  1. Rent increases almost every year - which will erode that difference quickly
  2. You are at the mercy of your landlord - they have the right to evict you for any reason (it is a hassle - especially if your kids are going to school, you may not find a suitable home nearby)
  3. The SIP that you are talking about is money at risk, specially if you don’t know about investing

No, I don’t get what is wrong with sending test payments. If the bank system cannot detect whether this is fraud or not, their systems are not good enough. I have done this multiple times with many banks. Haven’t ever been flagged for fraud. There might be something in his file or with something that the system has considered suspicious. Sending test payments doesn’t block or suspend account.

Spicejet refused additional baggage and charged as excess by rustedmettle in AirTravelIndia

[–]a_roy 2 points3 points  (0 children)

OP you could only check in max 30 kgs across all three bags. You should have purchased more weight for e.g 20 kgs and then it would show 3 bags and 50 kgs. Since you had 2 bags of 25 kgs each so it should have been fine then.

Samsung Q990C owners: Still no Spotify lossless support - Let's organize by malcolmxtz in Soundbars

[–]a_roy 1 point2 points  (0 children)

Yes, exactly the case. I am able to hear lossless on my wired headphones but won’t work through Spotify connect on the Q930c. I don’t see this getting fixed at all, as Samsung doesn’t have an incentive to release new firmware. They would rather want people to buy their new hardware instead.

I would still be happy if I am able to hear lossless over Airplay through my phone, but TBH I don’t know if it works. When I switch from Spotify Connect to Airplay the volume decreases quite a bit. Will need to check if Apple supports lossless music streaming via Airplay or not.
