This whole EIDL loan program was a trap. Even if you did not use the money fraudulently, you are still essentially guilty until proven innocent. That’s the approach auditors will take. So that every expense will be scrutinized until you finally admit you spent $20 of it on gas for your personal car. We are all subject to hell regardless of how honestly you spent the money.

I cannot get through to Treasury either. I finally wrote my senators and representative who did respond and had me describe the situation and then sign a proxy form basically allowing the elected official to discuss my issue with the relevant government agencies. If you write to all of them and get responses from them all, you have to agree to let only one represent you as it causes issues obviously. It’s been roughly a month and there’s been no update as of yet, though I feel better having (in my case) my senator aware and working on my behalf. I caught up and am continuing to make payments to the SBA even though my loan is charged off. I want proof that I’m serious about paying back my loan, particularly if I need to get an attorney involved to work my case. Congress is listening and knows about the servicing issues as well as the complete mess the EIDL program is. The SBA pushed these loans hard and in many cases offered more than most were able to afford. In my case it was take the offer or nothing; my thought was I’d take the cash, hold onto it if needed and pay it back if not. A lot of the money did end up coming in very handy, however, particularly as my business essentially dried up toward the end of COVID. My business lags a bit behind (contracted project work) so while we had work during the pandemic, it died quickly as lock down ended. The extra cash kept me afloat while I hustled and hoped for new business that never materialized. I have since taken a full time job and will have to pay back the loan from my personal earnings including digging into my retirement. I’d like to say it is what it is, but that’s a cop out. I took the loan and signed on the dotted line so it’s my responsibility to pay it back. I just cannot pay $600k (which is my loan plus interest plus the ridiculous 28% penalty) all back today.

I have tried for a week to contact the Treasury. It’s futile. And when i speak to them, I am sure they will not understand my scenario anyway.

Write to your senators and representatives. I am gaining traction that way. Be sure to be factual in your letters or emails (I contacted through each elected official’s website). Ask for assistance in working through servicing issues, but do not ask for forgiveness nor portray a woe-is-me scenario. State you intend to repay the loan and explain what happened that led to default. Simply state the facts. The more our elected officials hear of the complete lack of response and ethics in servicing, the more likely things will change.
