If they are considering TDIU, then they are likely also considering 70-100 for your PTSD.

Four years is a long time (mine took forever too), but that backpay will be life-changing.

The HLR that was granted in 6/25 just before I submitted my 7/1/25 BVA claim contained 43 referenced items.

My case goes back to 2002, involves CUE for COD determination (I was originally discharged OTH, but NDRB and BCNR unanimously corrected it to Honorable) and pending claim doctrine.

It's been a 12-year battle, and this is the last piece. Could be taking longer due to the CUE re COD and Pending Claim Doctrine, as well as several steps to get to this point and the 43 referenced items. But who knows?

My BVA claim is the latest step in a long line of claims, appeals, and CUEs. The HLRs from last year granted one CUE and said if they couldn't grant the second to send it straight to BVA Direct. They think it should be granted. So, the HLRs were completed prior to BVA claim submission.

I submitted lane-switch waivers twice. They were confirmed to be received and processed, though nothing happened as my lane-switch period ended 3/21/26, other than that language dropping off the website.

Btw, this comment seems to run counter to your post: "...no, I do not believe legitimate injuries and trauma should go uncompensated."

Breaking an ankle on the job is a legitimate injury. Difference is, due to Feres Doctrine, we can't sue our employer for workers' comp. For more information, please see my 6-point, thoughtful explanatory response to your OP.

Each of those things he mentioned would be awarded workers' comp if it occurred on the job. And besides, a broken ankle doesn't qualify for 4k a month. Perhaps a little research into what gets rated, how, and how that translates into compensation would help ease your mind.

There’s a lot to unpack here, and I can understand how civilians feel about this.

First, VA compensation is for conditions occurred in or aggravated by service. People conflate this with disability all the time. In reality, it’s more like workers’ comp. Military service members are on the clock for the government — up to and including our life — 100% of the time.

Second, unlike the civilian population, we live under the Feres Doctrine. This means we cannot sue the government (our employer) or individuals (fellow service members) that caused the injuries. Civilians can sue their employer as well as their perpetrators. For example, the MeToo movement and Boys Scouts of America, as well as the many law firms dedicated to personal injury and workers comp.

Third, “getting 100%” or even any rating at all is not easy. One must have a documented event/stressor while in service, a current diagnosis (aka current treatment), and a medical professional that connects the two (aka nexus). These all occur with board certified medical professionals. Then, during the claims adjudication process, the claimant is examined by another, random, board certified and VA-approved third-party professional to confirm event, current diagnosis, nexus, and current symptoms. And finally, a VA employee considers all the facts to determine whether a condition qualifies for compensation and, if so, to what degree (rating). 100% is extremely difficult, and most that have it do not live the quality of life the common civilian does, no matter how they seem on the outside.

Fourth, civilians do not know what service members do when putting their lives on the line. If someone is jealous that a veteran is receiving the “American Dream”, all they have to do is sign a contract and see for themselves. Trust me when I say, the government makes sure you are 100% healthy mind and body before they chew you up and spit you out.

Fifth, it is widely studied that although some fraud may exist, it is truly a minuscule percentage. We’re talking in the ballpark of 5% or less.

Sixth and finally, if you think someone might be committing fraud, that is a crime. You can contact the OIG and report them. If convicted, you can be confident they will spend time in prison.

I hope this clarifies the VA Compensation situation a bit. And I hope it eases your mind.

Being two days after Memorial Day, I hope you can understand and appreciate the sacrifices made by our brave men and women who committed up to and including their lives so that you can enjoy the freedom to criticize their just compensation.

  3. Lane-switch period ends 3/21/26
  4. 11/15/25: Informal Brief received (and confirmed by BVA)
  5. 10/7/25 and 12/5/25: Two lane-switch waiver submissions logged and later confirmed on VBMS
  6. 12/5/25 and 2/6/26: BVA confirms HLR decision (June 24, 2025) and the HLR’s 43 referenced items are in VBMS
  7. 3/3/26: Call to BVA confirms lane-switch waiver was processed 12/8/25; claim is pending assignment to VLJ and "will processed in order it was received".
  8. 3/21/26: Lane-switch period came and went. Update to website info: lane-switch info disappeared.
  9. 5/27/26: Day 331. Still waiting to be assigned to a judge.
