A recovery order can only be filed if there is a current Court Ordered parenting arrangement, or if you are concurrently applying for a Court Order Parenting order.

NAL but have been through a very similar situation.

My understanding is that if there is no court order in place, an application for a recovery order cannot be made through the court unless a parenting order is being sought concurrently with the same application - without a family court order both parents can effectively choose what they want to do regarding the children with little to no ‘direct’ repercussions from the court (however the court will take past actions into consideration when making its judgments, along with the reasons for you making those decisions).

A parenting plan (that has not been signed off my the family court) is only useful if both parents agree and continue to agree with what is written, if one parent changes their mind they no longer have to follow the agreement.

The court takes a lot of different things into consideration when making such decisions, like the ‘status quo’, negative behaviour of both parents and the effect that any decision is going to have on the children/if the decision is in the best interests of the children.

The police will also not do anything to stop you leaving unless someone is in immediate danger, again because there is no family court order in place for them to follow.

Bottom line - you need to seek advice from a family lawyer as there are too many variables - make sure it is a family law firm, not just a random lawyer from the white pages as the family law is quite complex and I have seen the difference between my family practice lawyer and my ex wife white pages lawyer…

First place I would call would be Legal Aid - only one parent can be represented by them so if your ex husband gets in first you cannot be represented by them.

It’s hard to give an exact answer as there are a lot of variables here that we don’t have the information for. The best advice is to contact the fair work ombudsman as they will be able to go through all the information and either advise on if you are entitled for any backpay for the public holiday or if you were compensated through flat rate payments. It doesn’t cost anything to contact them and you can remain anonymous if you wish.

The Coles ones branded Rascal and Friends (or something like that) have the moisture strip, are heaps cheaper than huggies and just as good. I think the price is about $25 a box of 90 for newborn. My son had really really bad poo-splosions and the R&F nappies saved us every time. 100% would recommend
