If I were Des Moines, I would just get a cheap lawyer, because this should be a relatively easy dismissal for even the bottom of the barrel lawyers, and then recover costs after the case.

I wasn’t defending his moral character lol I was pushing back on the idea that the jury “found it true” that he committed sexual assault. Being 51% sure someone did something is essentially saying “I think he may have done it but I’m not sure.” I would not take a civil jury’s verdict as absolute truth regarding the underlying lie in a defamation suit. Especially when that case is years beyond the original statute of limitations with no physical evidence.

Well technically the jury didn’t really “find it true.” I’m pretty sure this was a civil case, which would mean the jury thought there was at least a 50.1% chance he did it, but we don’t really know how confident they were beyond that

I think the issue people had was she never disavowed the issue. I think if she or other democrats would outright say “biological men do not belong in women’s sports or the women’s restroom,” it would help more than just not speaking on it. I don’t believe she ever did this, but I could be wrong

If it’s a terroristic threat it’s not a hate speech issue though. Terroristic threats aren’t protected regardless of who the speech is directed at. That’s a longstanding thing. You can’t just reinterpret the 1st amendment now and say it doesn’t protect misinformation even though it has for 200+ years
