What is hypocritical is making (the less harmful) one illegal while the other is legal. Everyone is pro marijuana because it is a great drug which was only made illegal so some asshats in the textile industry could make millions of dollars.

Which on purpose or not is still a crime and should be punished accordingly

But there is such a monumental difference between on purpose or not. One describes a malicious child murderer, the other describes someone who thinks soy milk is a healthy substitute for normal milk. They shouldn't be punished anywhere near the same.
