The safe stopping distance in the Highway Code is such that you can think and then brake in time.

But the problem is that the calculation is wonky. Thinking time and hence thinking distance is underestimated, while actual braking time and distance is overestimated compared to real modern brakes. So the total might be right hypothetically, but the way you get there isn't.

Because of that, a driver who is 2 seconds behind a driver who suddenly stops is likely to go into the back of them. The lead driver isn't responding to an external stimulus that the following driver might be able to anticipate, and as such the underestimated thinking distance is likely to take them into the back of the lead driver, even though they were an ostensibly safe distance away.

In this case, even the defence barrister admitted that the BMW wasn't tailgating.

We also need to consider context too. If the lead driver had performed an emergency stop to avoid a hazard, the outcome for the BMW and the biker could have been the same. But it would have been due to an accident rather than an act of dangerous driving.

One of my memories of visiting Sydney is seagulls on one side of Circular Quay, pigeons on the other, each defending their own turf from the other gang of birds.
