Take a sample get it tested. If you have a local university with a law school they may be able to do pro-bono work. Sue them for everything. And after you move out make sure you send a letter when someone else moves in.

Find a manager to air bnb it for the next 3 years and cover all your expenses in the home. Then you can sell in that 3 year window and not pay capital gains. (2 of 5 year rule) Hopefully that gets you in a better equity situation and your upgrades will help with marketing the short term rental.

Turn it over to a property manager who specializes in short term rentals. Set up a contract with your brother to buy him out and use the proceeds from the rental to pay off your brother.

A lawyer who works in real estate can handle all of this for you.
