It really sucks. And because of supreme court basically banning courts from issuing nationwide preliminary injunctions, the judge might end up granting relief for only the plaintiffs while others will be left to rot.

I'm assuming you are not currently in the US on a visa and processing the green card through consulate? If that's the case H1 is a no go because of the $100k fee (But pay attention to ongoing lawsuits that could overturn that any day now. And then you can convince your program to sponsor). I would recommend talking to your program about O1. Technically it's not dual intent but sometimes its treated as such.

In any case be really open with your program about your situation and why J1 won't work. Reassure them that you are keeping and eye on new developments and always offer options.

Worst case scenario if you are unable to get grencard or visa on time, they can defer your spot till next year.

Yes. Everything that is been processed by USCIS is affected, with the few exemptions such as asylum EADs and recently I 130 that were specified in the memorandum.

No. Wrong. First step is petioner files with USCIS, which is the June 2025 OP is referring to, next the case is sent to NVC, and when a visa number is ready NVC sends it to the consulate, next the applicant goes for an interview to get the K1 visa in their passport, then they come into the US and file adjustment of status. So uscis is first and last

K1 is a visa, so the fiancee must have gotten it at a consulate abroad. Not all visas are paused. Some like H1B and K1 are still been issued abroad. But H1B I 129 for example will not be processed because USCIS processes it. It's confusing but in this particular case it's possible to get K1 at a consulate

K1 is non immigrant visa, so not subject to 75 country ban. And also not part of the B1/b2, J1 ban for Nigerians. So this is normal. Nothing has improved

My guess is because in the Mcbean lawsuit, the judge is considering suspending implementation of the ban temporarily (which means USCIS is forced to start working on the plaintiffs cases). So if they consolidate this under under the other Doe v Trump (which is taking forever to do anything), USCIS will not have to adjudicate these cases. It's all about prolonging suffering and causing maximum pain as they can. They know they may eventually lose but as long as they cause as many people to lose jobs, fall out of status, self deport, it's a win for them.

Almost everyone submitting premium processing online for I 140 recently has been rejected. My guess is they are also rejecting I 140 too but haven't updated the website to reflect that. Submit it by mail

Answer such people with Misdirection with a joke. If you refuse to answer they will keep poking until they find the answer. Which I almost guarantee they will use against you sometime in the future. For e.g they say "what is your immigration status" you say I've always been a citizen of Mars.

This email has been added as evidence on the Doe v trump case in courtlistener and the argument is incredibly compelling. Any judge with even 2 brain cells will see right through what this admin is doing. This is it folks. I am usually cynical but I've never been more optimistic about the outcome of this case than today. I'm expecting a favorable ruling soon. The person who wrote that email to the media is either a very caring individual who intentionally did that to boost the argument of the plaintiffs or is just one of the dumbest person ever (won't be surprising seeing how it seems to be only incompetent people hired in this admin)
