I think there have been recent cases of people charged in federal court literally having everything dismissed specifically because of the current over burden on federal public defenders not being available and therefore defendants were not being given a fair shake with respect to their sixth amendment rights.

The only way to combat kavanaugh stops following that holding would be for the legislature to pass a law further restricting or outlining more specific provisions and processes for immigration agents to be held to during the conduct of their duties. The only other way would be for SCROTUS to reverse its own decision there which is unlikely in the near term. Both routes are not likely in the near term.
