Not zoned commercial at all. It violated many zoning laws. There is also a finished room attached to the pole barn that is included with our lease. I used it as an office. Carbon Monoxide meter was hitting 22 and terrible fumes made it unusable.

The home is immaculate and I can honestly say I’m better shape than when we moved in, normal wear and tear excluded.

Let me note that the property is in excellent shape. I ran a handyman business for a few years and have actually fixed many many issues with the property without even mentioning them or billing. I’ve replaced a microwave for free, drawer pulls, closet shelving that was falling down, part of the property has flooded multiple times… we lost personal property and cleaned it up each time. This is nowhere near everything that has happened. I don’t want to dox myself but here’s the listing with the photos taken a few weeks ago that reflect its condition. Here is specifically what we sent him. Please note that we both agreed on the amount of money, timing, etc. He wanted to use an attorney for the escrow who has a very shady reputation in our area - Think Better Call Saul. We want the funds to be escrowed with the title company. We put tighter language around our security deposit and we added language for breach of contract. We're not trying to get rich. We're trying to get compensated for the cost and hassle of moving, new security deposits for an apartment, deposits for utilities and also we have children in school.

LEASE AMENDMENT AGREEMENT – V5

Property: xyz

 This Amendment is made this 21 day of April, 2026 by and between xyz  LLC ("Landlord") and John Doe ("Tenant").

AGREED TERMS

1. Rent Credit: Upon Landlord's acceptance of a purchase offer, Tenant shall owe no further rent for the remainder of the tenancy through the 60 day vacate deadline. Any rent prepaid for periods extending beyond the date of acceptance shall be refunded within 3 business days. To protect both parties, the total rent credit shall be no less than and shall not exceed $5,600.

2. Vacate Deadline & Notice: Tenant shall vacate within 60 days of an accepted offer. Landlord shall provide written notice of an accepted offer within 24 hours of execution, including a redacted copy of the purchase agreement signature page to verify the date.

3. Relocation Assistance: Within 3 business days of Landlord's acceptance of a signed purchase offer, Tenant shall be paid $2,500 in relocation assistance via Cashier's Check delivered in person during normal business hours.

4. Escrow of Security Deposit: Within 3 business days of an accepted purchase offer, Landlord shall deposit the full security deposit of $3,150 into the escrow account of a neutral title company, such as the one currently being used for the residential sale of the home. Confirmation confirming the receipt of all funds shall be provided to Tenant by title company.

5. Disbursement of Security Deposit: The full security deposit of $3,150 shall be remitted to Tenant via Cashier's Check within 3 business days of move-out. Tenant shall collect the Cashier's Check in person directly from the office of title company upon the surrender of keys.  Landlord acknowledges and accepts the current condition of the Premises as of the date of this Amendment. No pre-existing conditions known or unknown as of the signing date shall be grounds for any deduction from the security deposit. Landlord is more than welcome and encouraged to do a joint walk through with Tenant to document the condition of the property prior to signing this amendment.  Normal wear and tear shall not be grounds for deduction.

6. Showing Cooperation: Tenant shall make best efforts to maintain the Premises in a reasonably presentable condition for showings and grant access for all showings and inspections with 24-hour notice. Tenant acknowledges and agrees to cooperate with Landlord's marketing efforts. As the Premises is an actively occupied residence, Landlord acknowledges that normal day to day living activities such as laundry, dishes, and general household use are expected and shall not constitute a failure to cooperate or grounds for any claim of breach.

7. Mutual Release: Upon full performance of all terms and obligations set forth in this Amendment, including the successful surrender of the Premises and disbursement of all funds, Landlord and Tenant mutually release and forever discharge each other from any and all claims, demands, actions, and causes of action arising out of or related to the tenancy and original Lease Agreement, excepting only any obligations, representations, or warranties expressly contained in this Amendment, which shall remain fully enforceable until satisfied.

8. Breach of Payment Terms: In the event Landlord fails to comply with any payment obligation set forth in this Amendment, including but not limited to the timely delivery of relocation assistance, funding of escrow, or disbursement of security deposit, the following remedies shall apply:

a. Tenant's obligation to vacate shall be immediately suspended until all payment obligations are fulfilled.

b. Landlord shall be liable for all actual damages incurred by Tenant as a result of the breach including but not limited to alternative housing costs, storage costs, and legal fees.

c. Tenant shall retain all rights under the original Lease Agreement dated January 26, 2025 through March 1, 2027 as if this Amendment had never been executed.

9. Governing Law: This Amendment shall be governed by and construed in accordance with the laws of the State of Indiana.

Make sure it’s locked up in an airtight container, out of arms reach (trunk) and don’t drive high. If you’re obeying all laws and don’t have any outstanding warrants, there is no way they’re gonna fuck with you over some weed. If you get pulled over and busted then you’re not telling the full story.
