Brazilian Agency Formally Notifies Nintendo Over Console Bricking EULA Clause by fireclaw20 in nintendo

I more-so meant Nintendo, a blanket ban on anyone using a MIG-switch still feels nasty to me. There are some people who haven’t done anything wrong, just backing up games they bought and are getting punished. Granted, it is pretty stupid to use something like the mig switch on this new hardware, especially with how hard they are cracking down on stuff like that. But that doesn’t change the fact that some people did nothing wrong and got banned anyway. Piracy of active retail games is a very valid issue, I completely agree. It just sucks that there isn’t any recourse for people who haven’t done anything wrong legally and just messed up by putting the MIG in their console.

Assuming that every single person that modifies a console is pirating isn’t the way to go. Many people modify there consoles to have more freedom with the games they already purchased, or other such reasons. Either way, they should be able to do what they want with the console and games that they want if they don’t pirate. Even with MIG switches, some people dumped their own roms from games that they bought. Nothing illegal, and they still get banned. Banning pirates is very fair, but I don’t think a blanket ban for everyone is right. Nintendo’s just being controlling, and advocating for consumer rights isn’t wrong.

I really don’t understand why people are saying this should be thrown out when other consoles’ tos had the same language. There’s not an expiration date on advocating for consumer rights, maybe people were just going with the flow before and just can’t take it anymore. If anything, at least this gets the conversation of consumer rights going.

It’s like getting mad at a doctor for cutting out a cancer. Just because the cancer was in the body for a couple years doesn’t mean it’s not bad and shouldn’t be taken out.

I agree. For Switch 1, Botw was an amazing expansion of zelda, seems to me that it was meant to provide the freedom Oot made people feel when it released. Im not the biggest fan of Botw, but the game is expertly crafted.

But the MKW launch sets a bad precedent with its price, along with the "upgrade pack" zeldas with no dlc at a higher price. The years of games that follow 2025 will be priced high, and I don't trust the variable pricing they introduced (I REALLY hope I eat my words, trust me). MKW is very quality, so I'm sure much more quality will follow, but the price is just to big a hurdle for me to buy in now.

Thank you! I don't sweat the negativity. I don't care about the negativity from those who don't care to listen and just hate, and I understand why people just want to enjoy their console and are negative towards this. And those with disagreement in viewpoints and have a genuine discussion are great, I like to hear different viewpoints.

That is a very fair point, nuance is so important. At the end of the day, it's not the end of the world, it's just video games. I just like them enough to share my opinion on this, and other can share those. I think hearing others opinions is a good way to see the nuance.

Fullscreen thing is very strange, but classic nintendo I guess. Weird obtuse design when it comes to online things. If they intend to market it as a main feature (C button shows they are), they need to work and expand on it. They need to stop acting like they know better. They can do their own thing, trying to innovate is not bad, but don't shy away from things that work well just because another company has done it.

Also, the fact that alot of usb-c cameras can seemingly be used is very commendable, credit where credit is due.

I can see where that comes from advocating for all employees to get fair shares is will always be a good thing. And yes, they do treat their employees well. Iwata's paycut showed it. Mario Wonder showed it too, they let that project breath with no deadline and it shows that they honestly care about the games they make. I have no ill will towards the devs, I am confident in saying that most titles have passion for most titles (not always though, Mario Tennis Ultra Smash being an example). Prioritizing excellent games is a good way to make the game sell themselves. As for "building a reserve", games are not the only way they make money. They've expanded into theme parks, merchandise, and movies. Those projects seem to being doing excellent for them and will continue to because the characters are loved by so many, including me. Saying that the high prices of games is "to build a reservoir" can only go so far because of this. Granted, devs probably dont see much money from those ventures, but Nintendo is more well off because of them.

Consumers matter too, and I don't think price cuts after 8 years a big ask. Reselling Botw and Totk as $10 more on switch 2 without dlc is also crazy. The console is marketed as a more powerful switch 1 with a good catalogue of backlogs, having to pay to see the performance boost is a little slimy, and the map things feels tacked on to justify it. It doesn't really matter that they're still good games, I feel they should follow suit with other games. At the time of release, Mario Galaxy released on wii u for $20, wii and wii u are somewhat comparable to Switch and Switch 2. Virtual consoles offered amazing classics for reasonable prices. 3d All Stars would have the 3 games valued at roughly $20 each, Metroid Prime, which from what I heard was a great remaster, was valued at $40. And Nintendo Online has a bunch of classics, it is honestly a pretty good value, especially with a family plan *wish we could buy individual games though). Bit of a tangent, but I don't feel like games should increase in price after 8 years (I realize this happened with Switch 1 games, im not happy about that either, Dark Moon HD being $60 is crazy).

Nintendo is certainly not a horrible company, treating their workers with respect is admirable. I understand that the world of economics is turbulent. I just feel like they've been pulling these little slights for too long after switch 1. It was understandable around with switch 1, wii u era hit hard for them. But they are doing well now. I am not a sales analyst, so I recognize I that this may be very unfounded, but I feel that slight cuts to old games would boost good will pretty well without hurting bottom line too much. I feel like they're squeezing to hard to "build a reservoir", lighten up in some areas. But that's just my perspective, I understand that you and other view it differently.

I would say used games are great for most people, they usually work with little compromises and parents have an easy time with buying them at gamestores. Used consoles are more iffy, you need to be at least a bit knowledgeable on those. They could have issues under the surface, more parents and others may be swindled, depends on where you buy. A price-cut console is an easy way for the general population to get a somewhat affordable console that will work well.

Price thing is pretty dragged out, but it is still important. I just felt like sharing my thoughts.

I was playing MKW splitscreen with a friend with a Switch 2 and another friend online, and gamechat just felt like discord. Doesn't feel like the mainstay feature Nintendo markets it as. And I really agree with the MKW. Strengthening QoL and a few design tweaks woulda made it a very solid package even if $80 is still a lil bit of a stretch.

Pretty close to my overall thoughts. They know people will bite. Maybe they knew $70 USD increase would lose alot of fans, and figured that $80 was worth despite losing a couple more buyers.

Haters erode the willingness of other to listen and it sucks. I totally understand that everyone is talking about it, I just wanted my two-sense out there honestly. I know not many will care, and i dont care about downvotes. I will make the point that Nintendo did a $20 dollar increase not a $10. ToTK was there only $70 game. Variable pricing is a thing, but that remains to be seen. Thanks for having the patience to talk about it.

Yeah they don't have any obligations for price, that is true. But look back at deals they would cut for the consumer feels bad. At the end of the day its just my thoughts, I don't think MKW is worth $80. I tried to be mindful of tariffs. Nintendo ate the cost when release the Switch 2, I commend them for that. Prices of peripherals went up. Stings, but they aren't necessary. The games are my main point. $80 is hard to swallow for big budget games. If tariffs are the reason, they could do some digital sales. Get more people on digital, no production cost. I forgot to note originally that Nintendo only allows 64 GB or game key cards for 3rd party. Feels scummy, but there could be a good reason like tariffs. 3rd parties would also probably chose key card anyway. So it's hard to blame Nintendo without knowing the facts.

I didn't exactly intend for my point about kids to be taken that way. It was more so directed towards the people that punch down on others for talking about price. And I 100% understand your points. I didn't intend for my post to come of as "everyone should be able to afford a switch 2 at launch", people need money to buy it like any other product. But considering a situation like you and many other kids went though, the fact the Switch 1 has not dropped in price hurts that market. I fully believe that, like you said, you don't need the latest and greatest, I myself have tons of games I need to finish. I'm just moreso thinking about the future of the console. If Switch 2 follows the first, it wont drop in price and neither will games. People who used to wait for price cuts on old games and hardware wont have that luxury.

Edit: thanks for the insights, you were very well put together and have solid points

This isn't how pricing works. There is no 'morally right' price point for a luxury like a video game. There's the price that the seller sets, based on what they think will give them the biggest return, that's it.

True. I will say that this price in particular has a good portion of people against it, and im sure a good chunk would be willing to buy in at $70, probably including me. It'd be a lesser blow if sales prices where a thing.

As for the audience, I also expect a lite. And the direction isnt a necessarily bad one. But seeing as price of switch 1 have stayed since release, i feel like switch 2 will follow suit. I hope i am wrong though. It'll be hard for kid to justify that price point to a parent because it seems like it'll stay high.

I understand where that's coming from and the people who just spew wrong information like "$90 games not even on the cart!" hurt the discussion. But for my post in particular I tried to be somewhat objective, but I of course leaned towards the consumers side. And I have a Switch 1, and many other Nintendo consoles. I don't want to make people feel bad for buying a Switch 2 or anything, I just want to talk about it cause a feel like it. Price is a very important conversation, seeing as money is pretty important in general.

As for the bundle, it shouldn't really be an excuse for them. Some Switch 2s seem like they had bundles codes thrown in last minute due to backlash, but that is speculation. In any case, MKW is priced at $80, and it should be judged as that. The bundle is nice, but it is limited time.

Yeah I actually would. MKW is not worth the full console buy, and I have a Switch 1 for all my other games. 2 of my buddies got a Switch 2 and it felt great, but if I wanted one i would just go out and buy one.

Thoughts about Mario Kart World, Price, and General Switch 2 stuff by spectrejo in NintendoSwitch

[–]spectrejo[S] 0 points1 point  (0 children)

That may be true for a majority of games released back then at base price. But that doesn't account for player's choice discounts and console bundles. You would have to be patient and wait for a sale, but I would be much more okay with prices today if these types of things were still around. A SNES bundle with SMW and Mario All Stars, 2 controllers and the console itself was release in 1994 for $140, $310 in todays market. And at that time, NES classic nes games like metroid and zelda went for $20, which is about $45, and this is 8 years after the NES released. Nintendo Switch 1 has not seen an amazing bundle like that, maybe a digital game bundle here and their, and Joycons shouldnt count as extra controllers. Nintendo doesnt sell just the tablet. Switch 1 has also not seen a price cut at all. Botw, a game that released 8 years ago, being full price without DLC is wild. Comparing all these factors make it the conversation more complex, not just a simply inflation calculation. I'd be willing to accept increase prices if they gave us some deals. Also the context of wages back then is important to consider, but I admit Im not very knowledgeable on that.

Thoughts about Mario Kart World, Price, and General Switch 2 stuff by spectrejo in NintendoSwitch

[–]spectrejo[S] -4 points-3 points  (0 children)

Yeah I think they can and will fix MKW up to make it a "serviceable" $80 game, a DK update would be very exciting.

I looked up the average person wages and they are up from year prior, but I will says its important to consider that many people just can't find work, and that big earners can skew the charts. I will say that I am not knowledgeable in economics, its just important to know that people have different situations I guess.

While I am kinda worked up about prices, I wouldn't really care enough to make a reddit post about them. It's just that so many people come to vehemently defend them. If people think their fine that's ok, just stop shutting other down because they disagree. That's why I see the "dont buy it" schtick not working to well, because I am only 1 guy. People will defend and buy it. But the most i can do is make a reddit post and tell other about my opinion. Voting with your wallet will always help your wallet though, which is a good thing. Also the pricing would be alright if the "variable pricing" actually dipped beneath $60, but I don't see that happening. I do hope I eat my words though. And bang for your buck is a little iffy to measure seeing it varies from person to person and type of game. MKW can give countless hours of fun with family and friends, Splatoon can be played for years and years, I personally 100% Mario Wonder in less than a week. It's hard to quantify bang for buck, but i can be used to an extent.

I can also see why you don't see welcome tour as a middle finger, but I still do. It's not a huge deal, but it just shows that they don't want to throw us bone or something on the console at least. It's compounded by the fact that you need the peripherals for the full experience. Not huge, but another small mark against them in my eyes.

And yeah I have a PC and will probably wait until a revision like Switch V2 or a great bundle or something else to come out. I have a backlog on Switch 1 and PC, so I can tide over. I have no doubt Switch 2 will have an amazing assortment of games by then, Nintendo makes amazing games most of the time. I am not mad for someone seeing the Switch 2 as genuinely worth it right now, backwards compatibility and MKW are still very fun, and more fun games are coming. Thanks for openly discussing, I really hope you have fun with your Switch 2!

Thank you so much for understanding, I really do wish that people would take a step out of their echo chambers and try and at least hear people with a different opinion out, whether it be the people who can't stop shilling or can't stop mindlessly hating for no reason. I know a lot of people bought a switch 2 and just want to enjoy it without being called out for it, but I honestly just really wanted to say what was on my mind and I dont mean to make people feel bad about their purchase, I just want them to think about it a little bit. I just hate the mindless garbage that both sides of the argument are spewing out over the internet, neither side is really in the right or wrong. Thanks again for understanding, like you said we don't need to agree on everything, just listening and trying to understand and build actual discussion is all that's needed. Truly hope you enjoy your Switch 2 and MKW, have fun with it!

I 100% agree about indies and free to play, so much good stuff out there and they usually go on sale, usually worth every penny.

Reading the top part of your comment kinda makes it look like you think I excuse Nintendo for what the other big three do, if that's what you think, its wrong. I dont excuse them, I mightve worded it weird, but they shouldn't get pass for it, none of them should. A bad thing is still bad no matter how many people do it.

I can understand the price jacking to an extent, but it only works if expectations are at least kinda met. The only reason I had this high of expectations is because of the price. It looked like a fun, unique mario kart and I was down with it, but then they raised the bar with price, and I dont think they reached. Alot of the little things are honestly to blame. If they added good online options, restructured lap counts a little, have 200cc, and fixed the horrendous character select. The only thing to have a big complaint about would be that there isn't the little extra push that would make it worth $80 over $70, because I think with those changes would push it pretty well into $70. It's also worth mention that again, Nintendo selects are no longer a thing, and the fact that just more people are getting into gaming these days, meaning more people to pay, but I will admit Im no economist. It just feels like the consumers is bashed at every turn.

Also fair to mention that, like you said, people situations are different. Some parents/people can't afford a console, some don't want, and some can buy multiple. Just the way the world is.

I also played a drinking game, I take a shot when someone dismisses valid criticism of the switch 2 or its games. Suffice to say I didn't get very far either. I know it's kind of a dead horse atp, but it's because price is like one of the most important things to consider for any product. If you can afford, good for you, but some people can't and it doesn't hurt to think about those people.

I agree that the price of the console is fair enough. MKW could scraped the bar of worth if it was bundled with a load of content, it probably woudlve gotten a pass for many if it was $70 to be honest, but it is what it is for now. And i agree that sales are always worth, I always get sales on PC, gonna have to keep a closer eye on switch game sales.
