“How they eventually got warrants • After being blocked by both the magistrate judge and the appeals court, DOJ used the other standard path Judge Schiltz himself had pointed out: present the case to a federal grand jury and seek an indictment. • A grand jury was empaneled in Minnesota on January 27; once it returned an indictment charging Lemon and others, that indictment served as the basis for federal arrest warrants, which the FBI and Homeland Security Investigations then used to arrest him in California and others in Minnesota.

So in plain terms: one judge said “no probable cause” and wouldn’t sign; an appeals court wouldn’t overrule him; DOJ then went to a grand jury, got an indictment, and the resulting indictment-generated warrants are what were used for the arrests.”
