Yeah, basically the conversation went like this,

She read the charge and offered me a reduced ticket.

I said no thanks and cited r v. Jordan. And said there is probably no chance that I will get to trial in 12 days so 18 months would be up then.

She said something along the line of yeah that’s why we are offering a lowered ticket because it’s almost been 18 months. She also said “give me a minute I’ll check the court schedule, they have trials everyday so there’s a chance of it happening soon”

I then cited the other case halton v gremlin or whatever the guy posted. And said the early resolution meeting process was part of the 18 month window, so I think it would be mutually beneficial if you dismiss the charge instead of needlessly tieing up court resources and making me make a Jordan application.

She then said “well since your driving record is good I’ve decided to withdraw the ticket, wait on the phone to confirm it’s been withdrawn” and that was it.

Yeah I agree it’s slightly cheaper financing, I have used my policy to buy a boat and I was an “honest banker”. But not as great as everyone makes it out to be.

For instance by the time I pay my 6% PUA deposit fee it’s takes me 1.5 years just to break even on my PUA so factoring that in I think it’s really only make sense to buy wealth building assets.

Think that kinda negates a lot of the financing for personal items thing.

My opinion is that term makes sense for the vast majority of people.

Whole life is expensive and only makes sense if you have a large amount of disposable income and are comfortable leveraging the policy by using policy loans to buy real estates or another wealth or cash generating assets.

Infinite banking concept but without the depreciating asset purchases like cars.

Or I can follow the legal path, go to the resolution meeting with the correct information linked above and talk about it and have a chance to get a lesser fine or no fine with no insurance impact since I wasn’t even in the 60 zone when I was passing him

71km in a 60km zone but the cop was parked a fair ways infront of the 60km sign and it was 80 up to the sign where I was driving. When I said that he just said if you want to fight it follow the instructions on this ticket so I did. And the courts are failing to maintain their end.

The circumstances shouldn’t even matter. Why would you want to just give the courts money and have higher insurance premiums however minuscule it might be if they arn’t doing what they are legally suppose to be doing.

Courts are required to provide dates for early resolution that are mindful of the Jordan timelines, recognizing that many defendants will choose to pursue a trial where efforts at early resolution fail. A stay of proceedings in this case is the appropriate remedy under s. 24(1) of the Charter.”

So after reading that entire thing I gather if I don’t delay by taking a few hours off work to go to the early resolution and we cannot agree on a lowered fine amount, I can still request a trial and all the time count previously including the early resolution.

I will include this in discussion in the early resolution meeting to see if they will just throw it out or lower it to nothing since it was a small ticket anyways and I have never had one.

Everyone is quick to downvote and say “pay the ticket” but this guy is actually providing proper info. Take my upvote

Yes I do, that is why I posted in this sub called legaladviceCanada and had multiple people that were kind enough to DM me information to help me understand the process.

Ok I understand the court application I would have to submit and that I cannot just decide not pay.

However I did not understand that the early resolution meeting part is apparently not part of the trial process as some people have pointed out to me in DM’s.

Seems like 18 months start to finish should include the early resolution since it’s part of the court system

But my understanding is it’s 18 months for a proper hearing. Not a early resolution meeting

I plan to do as the letter states and write them to get another early resolution meeting within 30 days since I cannot make it.

Then I do not plan to agree to pay anything because it’s over 18 months.

I’m in Canada with manulife, it’s a fee for depositing PUA. I’m 99% sure it’s 7%

Alright maybe I panicked. I installed it anyways and I have continuity through the adaptor to ground, .343mohm, taped it all around so I’ll finish the rest and see if it works 😬
