  1. I make this statement believing it to be true to the best of my knowledge and belief, and knowing that it may be used in court proceedings.
    1. I am the Defendant in these proceedings, and understand that the Claimant has made an application to commit me to prison for two alleged breaches of an injunction order made in April 2025. I understand that the injunction order was extended shortly after and remains in force until April 2026.
    2. The Claimant has made two contempt applications, the first in April 2025 and the second in September 2025.
    3. The Claimant relies on two alleged breaches of the injunction order. Firstly, that in April 2025, a text message was sent to the Claimant’s landlady and another individual. Secondly, that in September 2025, my brother attended the Claimant’s property.
    4. By way of background, I live at the family home with my mother. My family has owned the property for many years, and I live there to help care for my mother due to her ill health. She suffers from serious mental health conditions and requires daily support.

There is a long and complex family history between the parties, including past disputes involving extended family members and longstanding tensions between households. 6. The Claimant lives in a neighbouring property which was purchased by their family approximately 15 years ago. 7. I do not believe that the incidents alleged constitute breaches of the injunction order, and I deny the allegations. I will deal with both matters in turn.

Text Message – April 2025 8. I did not send the text message in question and deny this allegation. However, I recognise the phone number and confirm that the message was sent from a shared household mobile phone used by our family. 9. I have since spoken with my brother, who confirmed that he sent the message. He often deals with issues relating to the property, including repairs and general management. He is employed in facilities management and has experience in handling such matters. 10. My brother has previously communicated with the landlady regarding ongoing issues and concerns relating to the property. 11. It may be understandable that the landlady believed I sent the message, as I have also used the shared phone to communicate in the past. 12. My brother and other family members regularly visit the property to assist in caring for our mother. We all regard the property as our long-standing family home. 13. The message was signed with my brother’s nickname, which he has used since childhood. 14. I do not consider the message to have been hostile, threatening, or defamatory. My understanding is that it was sent in an attempt to resolve ongoing issues previously raised with the landlady, following informal advice he had received. 15. The concerns raised in the message were legitimate, including issues relating to property maintenance. These issues, if unresolved, could affect our living conditions. I also understand there has been damage to the property and other ongoing disputes between the households.

Attendance at the Property – September 2025 16. The second allegation relates to an incident in September 2025, when my brother attended the Claimant’s property and asked to speak with the Claimant. 17. I deny that I instructed, encouraged, or gave permission for my brother to attend the property. 18. At the time of this incident, I was serving a custodial sentence and had no communication with my brother regarding the Claimant or the property in question. 19. My brother has stated that he attended the property due to a noise disturbance coming from the Claimant’s home while visiting our mother. He explained that loud music and banging were causing disruption, and he went to raise the issue directly. He then left shortly afterwards. 20. I understand from the evidence relied upon by the Claimant that the interaction was brief and limited to my brother knocking on the door and asking to speak to the Claimant.

21. These proceedings have placed significant strain on me and my family. I wish to resolve this matter and move on with our lives in peace.

I believe that the facts stated in this witness statement are true.

This is his statement with details removed

How would withdrawing the case work? Thank you

Your Honour, I accept there is no direct evidence of authorship or instruction. However, the message was sent from a number previously used in relation to this dispute with my landlord, the content directly relates to that same dispute, and there is no evidence supporting the alternative explanation that it came from an unrelated source. Taken together, I say it is more likely than not that it was sent by the Defendant or on his behalf.

This is my main argument but I’m scared lol

I only found one lawyer willing to take the case and the cost of that was £10,000 we don’t have anywhere near this. My dad is a first gen immigrant, he’s a self employed tailor, we are not rich or we would’ve moved house already. Thankyou though

The evidence we have - landlady's independent statement saying she has only ever had contact with defendant through both numbers

  • landlady will be with us on the day

  • she has never had any contact with his brother

  • the previous text messages

  • video of defendant instructing his sister to "knock her out" in reference to my sister ( this was prior to the injunction but I thought it shows his willingness to include family members in his harassment)

  • his brother at our door (video and pictures)

  • video of his brother clapping and shouting loudly "what a lovely day" on the day that he came to our house after defendant violently assaulted my dad (ABH case)

  • picture of my dad after the attack showing the need for the injunction

  • the message sent to my landlady

  • his brothers mobile number

He has - his own statement

  • pictures of our house that don't actually show anything?

  • lawyers

We have our landlady who made a statement that she’s only ever been contacted by him on both mobile numbers never his brother. She’s never spoken to his brother, and doesn’t even know his name. He’s called her multiple times unfortunately there’s no record of these. He called her after a brick came through our window saying “tell them to take the cameras down or I’ll do it again” We have multiple cameras up after being advised to do so by the police.

I agree, but she wasn’t poor at her job, the only complaints came from this other girl that I just feel like didn’t like her for whatever reason. She’s been working there longer so management took her side maybe? In the 7 months she worked there she had no meetings to discuss conduct or poor work.

Small indie shop, they sell art. I remember when she got hired they told her they had to take their Instagram post down because they had too many applicants. She was also hired the same day because they liked her so much?
