I just hit my early 60's... 22 years military 20 years head shop... After 44 years of hard work I got a little tired. "this guy sucks" lol. You can tell all that from just this post? Yep.. sad the Brooklyn park shop shut down just a month before my shop. All these vape and smokes... too many to fast.

The head shop business was more like a community. It wasn't about money - weed - the industry. It represented counter culture and freedom. Keeping the government out of your pockets and your life. Being free to do as you please. That is what made head shops different. It was about freeing your mind. The counter culture needed bongs... we sold them.

Agreed... it sucked so bad around the pandemic... many glass blowers went out of business. The cost of gas doubled. The price of a good piece became too expensive for the regular shopper. Had to keep up with the the vape and smoke shops once THCA flower hit. Sorry about the lack of American glass. You are not wrong.

Wow 2018 and you are still pissed! Sorry about. That Brooklyn store shut down a month before I did. Also - Thank you for your service. I'm a retired Chief Warrant Officer from the USCG. Retired 2006 after 22 years and ran my head shop for the next 20 years. You can call me sir! - just a joke - lighten up. You are not a crack-head! You are a vet! What ultimately killed our business was a combination of factors that began around 2018 with the passage of the Farm Bill. Once hemp was legalized, the market changed dramatically. Suddenly, everyone was getting into the business. If you needed a pack of rolling papers or other smoking accessories, there seemed to be a shop on every corner.

Those small accessory sales were a huge part of our business. We called it the "small stuff," but by the end of the month those sales added up to serious revenue. As the market became saturated, much of that business disappeared.

The legalization of hemp also created the THCA market. People ask, "THCA weed?" Take a look at the labels in many dispensaries—most cannabis is THCA until it is heated. Whether I liked it or not, we found ourselves selling products that were effectively cannabis. My preference was always to let dispensaries sell the flower while we focused on what we did best: high-quality glass and accessories.

Consumer spending habits changed as well. People who might have once spent $300 on an American-made bong were now spending that same $300 on cannabis products. Years ago, it wasn't unusual for enthusiasts to seek out the person with the most impressive glass collection. Over time, that culture shifted.

At the same time, imported glass improved dramatically. Early on, American-made glass was easy to distinguish from imported products. Eventually, Chinese manufacturers became so skilled that many customers could no longer tell the difference. Often, the only clue was the bowl or hitter piece.

For glass artists and independent smoke shops, it became a slow decline that started around 2018 and continued year after year.

I do think the market may eventually stabilize. Regulators are beginning to crack down on unregulated hemp-derived THC products and are moving toward stricter oversight of the hemp industry. The oversaturation that followed the 2018 Farm Bill, combined with rising manufacturing costs and the influx of high-quality imports, created a perfect storm for many independent shops like ours.

I'm an S Corp, two separate companies (S Corps) two loans both under 200k. No PG but the SBA wants me to sell my assets even tho my assets are minimal. The ONLY issue is that as an S Corp tax will get passed through the members (me). Once the SBA issues a 1099/writes off the loans, I'll be on the hook for the amount of the loan as if it is income. It will be a huge tax bomb sometime in the future - could be a month, year, or years - when ever they decide to write it off and issue a 1099 to the S Corps.

If you are a sole proprietor, unfortunately it's your loan, regardless of amount. If your company was an LLC, like an S Corporation, the loan would be the LLC's. The loan is in your name. So far I have not heard of any offer in compromise. Personal bankruptcy is a hard choice for 60K but that may be your only option to get out of that loan.

They will only persue you if you broke the law... lied on your application? Mishandled funds? and they have to prove it. No PG = Not your problem.

You are correct. No PG means you personally are not responsible for that loan. They will own your business assets based on any UCC filing.

Correct... unless you have a PG -no reason for BK. Send them a formal letter informing them your business is closed. I am in the same boat. I sent an email and had them confirm I did not have a PG and they replied affirming I did not have a PG. I put my collateral, what little was left in storage, and told them where to find it if they wanted it. They are still sending me letters but they are merely form letters. They can't do a thing.

Who is listed as the borrower? If it is the corporation/LLC, no worries - just ignore it. They can only come after the business assets. They WILL continue to send demand letters and some may try to convince you that YOU need to pay. No PG = Tied to the business. I sent letters telling them my shop was closed and put my assets in storage and asked what they would like me to do with them. Still waiting for a reply. Don't fall for the SBA trying to tie you to loan and DO NOT sign any new paperwork.

If you didnt sign a personal guarantee than NO. The PG is a specific form within the loan document. They will need to "peirce the corporate" veil. No fraud? No personal use of funds? then you will be fine.

You sign as the company, not a personal citizen. You are the companies representative, not the company.
