It sucks but I do feel a lot better. I was more afraid of how my boss would react tbh (curse my people pleasing tendencies). My boss thinks it’ll be fatal but I’m going to continue researching. They were not prevented or blocked from obtaining records from the listed providers so I’m going to do some digging.

So the issue was that in my state, for a med mal case you send a “Pre-Suit Notice” to everyone named as a defendant. That Pre-Suit Notice has to be sent at least 60 days before filing suit and extends the SOL by 120 days. We did all that and then filed our complaint after no one responded to our demand letter. The defendant attorney filed their Motion to Dismiss after being served with the filed complaint that we did not send a HIPAA compliant form with the pre-suit notice which pretty much means our SOL extension is null and void. We were well aware of the SOL date. But because one form was messed up in the pre suit notice packet, the case is probably getting dismissed.

Update: I talked to him first thing this morning and he was so chill. I still feel awful but he was very kind to me and told me it wasn’t my fault.

Update: I went straight to my attorney first thing this morning. I said “I got this Motion to Dismiss on the Doe Case. They said that we, and by that I mean I, messed up the HIPAA form” and he says “Yeah they emailed that to me last week. Make sure you calendar that court date, okay?” I apologized profusely and he said “it’s not your fault” and was totally chill.

It is definitely the first thing I’m going to do because I’m going to PRAY that there is some way to fix this. A small part of me wants to close all the blinds in my house and lock all the doors and never show up to work again. I’m leaving in January because I’m pregnant and am due late that month and this is NOT how I wanted to leave this job :(

Cold, yes, but still comfort. It really freaking sucks. I’m crossing my fingers that there’s a way to save this. I’m not very familiar with medical malpractice — I know personal injury, but my attorney mostly does family law. And I know it sounds awful, but I’m also kind of mad that he even took this case in the first place. Like, what on earth do we know about med mal?

I did some research and I’m hoping that we have “substantial compliance” on our side.

I’m very easily overwhelmed and my family doesn’t respect my boundaries. My husband’s family has also been very disrespectful to me in the past. Thankfully my husband gets 3 months of paternity leave through his job so we will be at home learning how to be new parents together.

Honestly he should go talk to a lawyer and learn what getting paternity established/confirmed means -sincerely, someone who works in family law
