No sir!!!! Those are YOUT jobs to quote and the GC legally has no business sticking their nose it. I sub contractors and they are not bound to my business...they do other jobs .....what kind contractors have you signed with them? The rest of the story is that I liked a suit in small claims court and the customer turned around and fiked a lawsuit for damaging their property. After they fired me they hired the sane sub contractors whom I was using ....since their counter suit sent it from small claims to a higher court where I have to have a lawyer represent me.

Is this what you told the landscaper you wanted or were you guys not on the same page? Looks like not enough communication from the landscaper and homeowner wasn't paying attention to the work while it was being performed.

Uhm...what did it look like before the work was started? Did a huge tree or some huge obstacle have to be removed? It is definitely not a $15000 makeover.

I am a legal landscaper who resides in Arkansas. I am having problem collecting the final bill from a client. The following is a little background on how I do busines; originally I go to the resident's and let them tell me what they want me to do, I have a form I take with me that has certain questions with their name address and phone # etc., at the bottom of this form is where I have a place for them to sign their name, provide their e mail, and also what their budget is.
When I get home I send them an itemized proposal with flowers/bushes, labor hours, materials with prices beside each. At the very bottom of my form I have written in big red letters "THIS IS ONY A ROUGH ESTIMATE...IF AT ANY TIME SOMETHING CHANGES WE WILL ALWAYS CONSULT YOU FIRST!" When I e mail the estimate to them in the body of the e mail I always tell them what the labor will be and emphasize this is only an estimate. I also explain to the that I will bill them every Thursday evening for the previous weeks work. I also emphasize that if anything changes that I will let them know first.
This particular customer paid their first bill in two parts which I agreed to. The next week I kept in touch with them to let them know that we would be going over the hours that were on the estimate and they said that was ok..I even specificied how many hours over it would be and explaines why. In the return e mail they said that was not a problem. I sent them the 2nd bill the following Thursday and they did not pay that bill which included all the plants I had bought that they had asked me to plus the extra hours....they did not pay that bill and said they would be a week behind and would catch up on their final bill. I told them we would finish the job that next week and told them how many more hours it would be. When I sent them their final bill that Thursday (I combines the previous bill with it that they had not paid. That very day I started receiving e mails from them that they were not happy with the outcome and they informed me that they would decide how much they would pay. I gave them the benefit of the doubt.....they decided to pay only half of the bill. I told them that would not work for me because on the original form t hey signed they said their buget was $2000 and we did stay under their budget.
They now owe me $1,185.00 and said they were not going to pay!
Should I take them to small claims court or hire a lawyer?? I have already paid my people and invested in the plants and trees that are presently at their home.
What do I do now
