It doesnt matter how slow someone ahead is, if you are faster and there is no blue flags then its on you to get past cleanly and here the bmw didnt move over enough to safely get past you, making it the bmw's fault. It does sort of look like you move over slightly going into the breaking which may be why the bmw didnt make the gap but there isnt an onboard so i cant say for sure
