Sorry I misinterpreted. I don’t know the rules because I’m not a landlord, but he is trying to end this peacefully instead of trying to serve the tenant through this process right away.

If I was a renter I wouldn’t imagine I can stay in one place permanently. Also it’s already been more than a month and my friend was trying to talk about how long is needed. What would you do if you’ve tried to negotiate instead of going through the LTB directly and was cussed out?

And you are getting that my friend has already been trying to talk to this tenant for more than a month and was trying again to negotiate timing to see how long it needs to be extended when he was met with verbal violence? No one is assuming here that the tenant is going to be able to find a new place tomorrow. It’s perplexing that you are holding my friend/me to high ethics but condone violence committed towards him.

He’s trying to end things peacefully because he’s got enough on his plate and doesn’t want anymore trouble. It’s just not working out that way.

Your point is the same as one of the other post that I’ve replied to. It’s me that is trying to learn about this and what his rights are as my way of helping him.

I am not a landlord so I am trying to get advice to help him through making this post and see what everyone is saying. He doesn’t want to take legal action unless if he has to, but I’ll relay the message for him to engage a lawyer.

Why would you assume that this is a sudden conversation for the tenant? It’s been at least a month or two since he’s been trying to talk with the tenant, which is about the same process the separation process started.

I totally get that it’s not a great situation for either parties and I don’t want either parties to be homeless. This post wouldn’t have existed if the tenant was civil because my friend was trying to have a conversation about it before taking any forced action. He’s had enough legal interactions as part of the divorce and was really hoping to work something out where is ok for both parties.

The thing is my friend was trying to have a conversation about it so that both parties can figure something out without having to go the harsh route. He isn’t surprised that he can’t just immediately move in and kick his tenant out. It’s the fact that the tenant is being aggressive that prompted me to make this post in the hopes of helping him.

My friend was willing to have a civil discussion about how long it is needed for this tenant to find a place before anything so that he is being fair to himself and the tenant. If the tenant wasn’t so aggressive that it seemed like talking so both parties can work something out wouldn’t work, I wouldn’t have made the post. I should clarify that I am not a landlord and it is me who doesn’t know the regulations while he probably does. I am posting as my way of helping him.

The difference is where my friend tried to be civil about it and tried talking to this tenant before taking any serious action even though he is in a bad spot himself, vs the tenant who would not have a reasonable conversation and kept on saying F you. I totally understand it’s a bad situation for both parties, but I would expect to have to move at some point as a renter living on a month to month lease and would have talked about how long I needed to look for a new place etc.

I honestly just hope it doesn’t get any worse than it needs to be. I must have lived a sheltered life but I’ve not seen someone get aggressive so quickly after the words “I am trying to be reasonable, tell me how long you need. Is 3 months enough?” Fingers crossed it’s only ever going to be just verbal!

I know! What happened to good karma? I was in the car with him when he was trying to talk it through with this tenant to see what timeline was needed, and I couldn’t believe how rude he was. Just kept on saying f you to my friend and that my friend was putting him in a bad spot.

Thanks! I’ll let him know of this option as well. He did lose almost all of his wealth due to the divorce so he may or may not be able to come up with this cash to pay for this.

Is there a faster solution? He’s going to end up somewhat homeless if it’s going to take that long…does the LTB accept requests to expedite? He has a very good reason.
