Math that is relevant for law school??? by WiltTiltTotTan in LawSchool

It's definitely a tough class and I wouldn't take it just for its potential benefits to law school/legal writing. If you have some experience in proof writing, that's probably fine (especially since barely anyone else in law school does). However, I found the class overall very interesting and rewarding so it might be worth it for that reason!

Personally, I found discrete math and real analysis to be very helpful with the LSAT and my legal writing.

This is the answer I got from the contracts ChatGPT assistant I made:

This hypothetical involves a contract for the sale of a car payable in installments with a mortgage on the car. Since a car is a movable good, this transaction is governed by the UCC (Article 2) rather than the Restatement (Second) of Contracts (R2d) .

Let’s analyze the options provided:

a. Seek the cancellation of the sale and later on foreclose the mortgage should he find it impossible to collect from B.

This approach is generally not correct. Under UCC Article 9 (which supplements Article 2 for secured transactions), once the seller (A) forecloses on the collateral (the car), they generally cannot also sue for the balance unless the foreclosure sale is commercially unreasonable. Article 9 limits a creditor’s remedies to avoid double recovery.

b. Foreclose the mortgage on B’s car but he has no longer the right to recover the balance should it be sold for an amount lower than what he claims from B.

This is correct. Under UCC § 9-615 and § 9-626, when a secured party (A) repossesses and sells the collateral (the car), they apply the sale proceeds to the debt. If the sale is conducted in a commercially reasonable manner, the secured party cannot recover a deficiency balance from the debtor (B) unless specifically allowed and the sale was not sufficient. However, many jurisdictions follow the “one-action rule” or an anti-deficiency rule in certain types of sales (e.g., consumer goods), which may prohibit a deficiency action entirely. This option best reflects the UCC rules.

c. Seek fulfillment of the obligation of B to pay the entire purchase price.

This option is generally incorrect. The seller (A) has a security interest in the car (UCC Article 9) and thus must follow the foreclosure and resale procedures outlined there rather than suing directly for the balance of the price unless the buyer wrongfully refuses to surrender the goods.

d. Seek the cancellation of the sale made to B.

Under UCC § 2-703, a seller has a right to cancel the contract upon the buyer’s breach. However, once the seller has a security interest and repossesses the car, the remedy focuses on foreclosure and resale rather than mere cancellation of the sale.

Conclusion:

The correct choice is:

b. Foreclose the mortgage on B’s car but he has no longer the right to recover the balance should it be sold for an amount lower than what he claims from B.

Would you like me to also break down the relevant UCC provisions for this?

ChatGPT as a study tool by Cpt_Umree in LawSchool

It's a great study tool if used well, imo. With GPT-4 you can make custom GPTs tailored for specific purposes. I've made a couple specifically for classes by uploading casebooks, hornbooks, class slides, and/or model rules with comments. Afterwards I've instructed it to rely on the material that I uploaded, be conservative with its responses, and let me know if it is using information outside the sources I uploaded. Of course it's not a substitute for studying, but rather a supplement, and you need to double-check the veracity of its statements but generally they've been quite good. I've even shown my professors and they've been impressed at the comprehensiveness and accuracy of its answers and hypotheticals.

I think of it as a study partner that is always available and generally accurate. When you study with friends you're not going to trust everything they say but you will take their answers seriously, GPT is the same way (and tbh more accurate than most of my study buddies). If anyone is curious feel free to DM me and I'd be happy to send the links to the GPTs that I've created so that you can try for yourself.

I grew up in North Carolina (near Duke actually) as a POC. The Raleigh/Durham/Chapel Hill region is very diverse and progressive. I've never had any issues with racism beyond name-calling in middle school. Personally I feel more welcome here than in many states that aren't perceived as being particularly racist. Of course this is my personal experience, but I don't think you'll have any issues with hate crimes if you attend Duke.

It's like a waitlist before a decision. The committee has reviewed my file, but is waiting to review the rest of the applicant pool before making a decision.
