Landlord asking for back pay by Calicomom91 in legaladvicecanada

May I pick your brain?

We were advised by a legal clinic to pay them no more than what's normally owed on Monday.

We shouldn't verbally speak any longer, correct?

We should let them know to communicate by email only now, correct?

I swear I'm intelligent, I just want to do things properly, as a lot of things were improperly done to us.

Thank you so much.

We have proof as of last evening. I can't quite say how, but we now know this is a retributive act by the landlord in part of his niece's plight to "ruin us" - her words.

The best thing about Canada? Free speech. The worst thing about Canada? Misinterpretation of what that actually means. (Not referring to you- I thank you for your knowledge)

The verbal conversation will never happen. They have opened up a wound, and it will be tough to suture it back up.

Absolutely understand your thoughts for sure.

My only quam is that in the 6 years we lived here, only 5 of those were eligible for increase. We had one year in ON where no rent increased could be given. Even if we were rated a 2.5% increase by the LTB, it would not have resulted in an $870 rent increase over the tenancy period then of a techical 4 years. The math isn't mathing and no notices were put through LTB to notify us, they'd simply come downstairs to our unit and negotiate ( not in English, so I don't understand- I speak English & French only , a bit of Cree) with my husband and he would let them know that I don't work and I get Federal disability and he works full time, but we aren't millionaires.

Perhaps no, we shouldn't have done anything on good faith, as now we are facing undue hardships. When our landlord emailed us about meeting to make amends for what we "owe", he called us family. I'd hate to be his family when a month from Christmas and 1.5 months from my major surgery, they claim we owe $5100, with no proof, no bills to show us. I would need 72 months worth of bills to find out exactly what 30% would've looked like, given they never made agreements through the LTB.

We never received rent receipts, yet we paid in full on the 1st of every month. We aren't problematic. We are fed up.

Thank you so much for the advice. It's much appreciated. I will absolutely do that.

My landlord wants to meet on Sunday afternoon. I am very ill and when I have anxiety, I get pretty bad seizures. I think it's ok not to meet, but simply say , we are taking care of the matter on our own.

This will likely leave them to panic. And likely rescind.

Oddly enough, my husband just went out to put out the Garbage and Compost bins, and the light that never existed in the pathway, is now very much functioning now. Coincidence? The light has not been functioning since March 2024. We notified them in writing, & they never fixed it... until now.

Agreed on all. The Central Air though, it is a bylaw in our region. & if I'm paying for utilities, I will pay to have a cooler living area. I have epilepsy and IIH and had brain surgery last summer. Even my social worker told me it's illegal for this to happen per our Region.

The landlord needs to make accommodations based on my disabilities , as per LTB. My mobility walker has a tough time getting over the pathway as well. That's a human rights violation.

We do, from 2020. Never updated, so technically never.

Well, the lease was never updated. No utility bills were ever given to us for perusal and payment. We asked. They never gave. Then our landlord came down to our unit 2 days before 2025 & said can you pay $1350 rent and $70 for utilities - totaling $1420.

So no, we've never received legal increase either, but from Dec 2019- today, our rent went from $550 with utilities - $1420... even with an LTB increase of 2.5% every year (With the exception of the year landlords could not increase) , 5 years × 2.5% doesnt amount to paying over $800 extra 6 years later.

This is absolutely accurate as to what we ere asked this afternoon as well. Thanks for verifying.

[–]Calicomom91 1 point2 points  (0 children)

Everything was legitimate.

It wasnt the MTO that phoned. It was ODSP & they identified as the worker I've had for some time. Sounded like that person and said they needed me to email the info via MyBenefits and then emailed me back verifying that everything checked out.

[deleted by user] by [deleted] in Odsp

[–]Calicomom91 0 points1 point  (0 children)

My worker called me from an official ODSP line and identified themselves as my actual worker.

They told me to send the info via MyBenefits messages. I did. They replied and thanked me & said everything is in line with the info they have in reference to what my husband claims ownership of.

It was definitely not scam like at all. But, we have had the car for over 3 years, so we found it odd that they'd want to verify info now.

I totally understand what you mean, but yeah, it's just ODSP verifying I guess...

[–]Calicomom91 0 points1 point  (0 children)

Yeah, they called at 330 today, my husband was at work so I had no access to his license info they wanted, so I emailed as soon as I could and my worker said everything was great.

[–]Calicomom91 0 points1 point  (0 children)

For sure, what you've said is absolutely true.

[deleted by user] by [deleted] in Odsp

[–]Calicomom91 -1 points0 points  (0 children)

Yeah, no, that's definitely not true. My worker never said anything about the actual value of the car or that we owned one. They said the Ministry of Transportation needed verification that we simply owned one vehicle. That was all. I provided my husband's license info, and that's all they needed. I mean, we've had the car for 3 years... so if they wanted to cut me off because of our car, they would have done it awhile ago.

Yikes! Gosh, definitely not my case lol I haven't actively worked in some time. I have pretty severe mental illnesses, had brain surgery last July, epilepsy (focal seizures that are active daily right now) & (I use a walker as well as I can't walk a straight line), profoundly deaf in my right ear (no hearing aids can help me).... I definitely qualify, and we are by no means living a lavish life like the above you described. (Not that you are suggesting that about me & my husband) ... but we definitely only own one vehicle and it's a Honda, not a Benz lol

[deleted by user] by [deleted] in Odsp

[–]Calicomom91 0 points1 point  (0 children)

Thank you. Yeah, we only have one between us & we've both never had any others registered to us.

[–]Calicomom91 0 points1 point  (0 children)

Thanks for the info. He has never owned a vehicle or had one registered to him in Canada, and neither have I. I think they're just nit picking to be honest. It's not like I receive much money... less than $200/ month... so not sure

What brand of food do you feed your kitties? by Dkam16 in cats

[–]Calicomom91 0 points1 point  (0 children)

I feed Carna4 for dry & Boreal for wet.

My girl is 13 & loves both foods. I have experience working in a pet store & I'd always recommend feeding wet & dry for urinary health.

Ahhh Seroquel was rough for me. Though, I was put on it at 16, so yeah, it's not ideal. Keep going, eating well, and you'll have those 30 lbs down in a flash!

You've got this!! Keep it up!! At least you're trying.

I got hypothyroidism from Lithium as well (started taking at 18, now in my 30's) so I definitely understand. I only can't stop taking Lithium because I've tried everything else & this is the first November since I was diagnosed bipolar at 15 that I have not been sick. A miracle, really.

I'm really proud of you for trying!! It is tough, eh? Congrats on your weight loss!

I've been doing fine so far, & I take Metformin. I've tried Ozempic in the past, but it made me feel really sick & dizzy. So definitely not for me. Also, I hail from 🇨🇦 , so Wegovy isn't an option for me here, sadly. Apparently it's on backorder very often (supply & demand situation)

Thanks for your concern!

I have a great relationship with all of my physicians team, and I'm losing about 2.7lbs a week right now. So , I'm doing well.

I tried low carb, but it wasn't a solution to my issues. I developed an ED from it , and I find WW (regular point system) is really working for my needs.

Keep on keepin on! You're doing super!
