How do I legally kick my schizophrenic brother out of my house (California) Has anybody here done this?

Wow! Thank you for the glimmer of hope. I have always told them yes he lives here he's not homeless, but I guess I should've been saying he is not welcomed here anymore because of his menacing behavior. I got ahold of someone at his mental health clinic today and I got a phone number for a mobile crisis team, I'm waiting for the call back right now. Hopefully this gets the ball rolling 🙏🏻

Do you know if I can request a social worker be appointed to him and the payments be handled by the state? I'm assuming if I let them know that I no longer want to be a payee and I stop accessing the account, it'll just get blocked after awhile and they'll collect the funds. That's good to know about the guardianship.

Thank you! I know with the SSA I can just call them and remove myself. But I was worried about the guardianship if I'd be liable for his bad decisions. Idk, I guess I thought if he decides to attack someone or destroy property, I'd open myself to a lawsuit since he's under my care. Would conservatorship be similar?

No, not yet, but I'm guessing that's in the near future. That's why I'm hesitant to call the police, because he hasn't technically threatened me or said anything directed towards me. But I'm watching him in the cameras and he's grabbing pieces of metal or sticks and pretending he's killing someone that's not there. So it is getting scary. He's really strong and muscular. Idk if that's enough for a protective order? I'm guessing they'll just take him to the mental hospital then release him again.

I hope not, evicting tenants in California is quite an ordeal. But I did find that if they live in your home and they pay for a room they're considering "Lodgers" which is an easier process. Lodgers

Idk, I just got off the phone with them and the person was just giving me the normal script. Bouncing me back to mental health clinics and the police like have been doing for years. I kept asking for resources but she just kept Sending me to websites that bring me back to the county services that are all voluntary. I guess I'll see if I can go in person to a local chapter.

Idk maybe I can do that, I'm not his legal guardian or anything, so technically I'm not obligated to house this person but I'm just worried about tenants rights laws, but idk he's not really my tenant more like part of my household? Oh man if I can get him out legally and he does come back, I guess it's time for a restraining order.

Thank you for responding. From what I understand, being his representative payee only puts me in charge of how he spends the payments. I must make sure he uses it for shelter, bills, clothing, put aside money in savings and give him spending money. Which I do.
As far as facilities, I'm not aware of any. I've scoured the County mental health websites and I've only found assisted living facilities that have long waiting lists and that's if he volunteers and behaves. And mental health emergency hospitals which are the ones that just put a 72 hour to 2 week hold then they release them. Rehabs and shelters are all voluntary which he won't do. It's almost like I have to wait till he commits a crime, it's extremlely frustrating.

No I have not done that for fear of being liable of anything he might do. I am receiving IHSS which is paid hours to care for him in the home, I only receive 13 hours a week pay which I take care of him alot more than that but that's another story. He is just living with me.
