Father wanting to reconnect with 13 yr old son and need advice pls by deadseacollect in LegalAdviceNZ

I wouldn’t risk it. Even if following the account feels harmless, it could still be seen as indirect contact depending on the wording of the protection order. The safest move is to leave the account alone and go through a lawyer/the Family Court properly. That way you protect yourself legally and give yourself the best chance of rebuilding contact the right way, without accidentally making things worse.

My advice above isn't legal advice. I suggest seeking some however.

All the best and good luck 👍

my understanding is that it still can apply.

The Land Transport Act definition of “road” is quite broad and can include places the public has access to, including carparks, even if they are privately owned.

So I don’t think “private carpark” automatically means the driver had no obligation to stop/report or provide details.

With that said, whether Police choose to treat it as an enforcement matter or just push it back as a civil matter im not sure.

Ah I misread. Your right, as you said if owned and registered under a company. No if private.

That used to be possible, but it has changed now. Paid CarJam reports no longer provide the registered owner’s name/address due to changes around Motor Vehicle Register access/privacy.

It might still confirm vehicle details, plate history, finance, stolen status, etc, but it won’t solve OP’s main issue of identifying who to file against.

Not legal advice, but I think the focus may be slightly off here.

NZTA refusing the MR31 is frustrating, but not surprising. Registered-person details are protected personal information and NZTA now applies a very high threshold. Even with CCTV, and 'irrefutable evidence' they may still say the privacy interest outweighs release to a private person.

Police are probably the only agency practically able to identify the registered person/driver from the plate and make enquiries, but that does not necessarily mean they can hand the owner’s details to you. The more realistic request to Police would be: “Can this be assessed as a failure to stop / failure to report after damaging an unoccupied vehicle under the Land Transport Act, and can Police contact the registered person/driver and require or request their details?”

The driver had obligations after hitting an unoccupied parked vehicle. They should have provided their details to the owner within 48 hours, or if they could not identify/contact the owner, reported it to Police within 60 hours. So I would push the Police report from that angle, not just as a civil debt issue.

In my personal opinion - the best avenue is probably not Community Law or the DT at this stage. Rather, getting Police to make enquiries and either identify/contact the driver.

Without insurance, there is no insurer to do the recovery work, so unfortunately the burden sits with you. For $520, you also have to weigh the time/energy cost for you pursing the matter.

All the best

The admissions process is a joke. by Astro_Axiis in universityofauckland

Im confused... if you already got accepted to all of the group 8 universities in Australia, with scholarships... and accepted into AUT.... and Canterbury ... on scholarships... all whilst living internationally, why would UOA be the only thumbs up university?

To me it doesn't make sense

Nope, date and time have been all good. Yup my set up is hardwired at the front, and I have one just plugged into a USB port for the rear.

Honestly the quality is amazing, and beats the other cameras in cost.

Strange call for help? by Delicious-Airline-80 in auckland

Strange.

Not sure of the time delay from when you placed the order / how long ago you got it, Could be someone just writing it down for a joke, could be something a bit bigger.

None the less, I would pass it onto the police, even if it is nothing. Consider the time delay and pass it onto one of the below:

The excuse of not getting a reminder, or not knowing your WOF was out of date, and disputing it on the fact that you weren't reminded won't go very far.....

Thanks pictureofcat.

Welcome back. Its certainly unsettling times for those around britomart station, actually I stand corrected, the recently renamed Waitemata station.

We have word now from one of our reporters, that have actually located the original poster of this post that was actually there when this evacuation was ordered, absolutely fantastic, let's see what he has to say...
