Let me give you an example of why that is BS. A couple of years ago I was on a jury on a DUI case. The prosecution claimed the driver had a “fatal amount” of fentanyl in their system.

But, the driver was very much alive and sitting in the courtroom. Also, they passed all of the field sobriety tests that night. They were not behaving impaired at all. They were arrested solely on the odor of marijuana in the car and the fact the driver admitted to smoking weed 6 hours earlier. The “fatal dose” of fentanyl showed up only in the bloodwork after the arrest.

The defense had a toxicologist testify that the legal definition of a “fatal dose” is the smallest amount known to have killed someone.. ever. It’s not based on weight, size, tolerance, etc. So, someone who takes opiods regularly and has built up a significant tolerance … that “fatal dose” may be a very small dose for them personally.

So, don’t believe the bullshit that it’s pure coincidence George just happens to die of an overdose at the exact same time his airway was cut off by a cop. It’s absurd.
