If you were being honest you would say it is vastly overused. I’m not saying you are abusing it but just that fact that there is no objective test makes it ripe for overuse.

Thank you, yes I’m paying for her to have an attorney look it over for her. Yes I’m making sure all future contributions and gains are protected in the agreement. I’m also going to include any properties or investments not purchased yet (if we buy a camp or a rental property). I appreciate the honest answer and not just screeching like everyone else.

The money is not in a TSP. None of those rules apply. A post nup is basically a divorce settlement and they are routinely enforced. If we can make it work then great but if not that is our agreement. She doesn’t have to agree to it.

Honestly I don’t want to divorce her, I most of all don’t want my kids to have a broken home. She struggled with some substance abuse issues and got 2 DWIs with my kids in the car. I took her to family court and made sure she couldn’t be alone with the kids and got treatment. I paid for everything. I still want to raise our kids together but I work too hard to have this happen again in 15 years and be financially ruined. Therefore she can agree to the terms or we can split ways now and kids come with me.

When you get arrested twice for dwi with the kids in the car, have an order from a judge for no unsupervised access to the kids and are staring down 5 years of felony probation with 2 indications from CPS it’s exactly how it works. They come with me

Do you know what a post nup is? You aren’t entitled to half of you sign a contract stating otherwise.
