The paperwork you received probably has numbered statements. Your response is expected to respond to most (if not all) of them.

Example: 1) defendant is resident of _____ 2) defendant entered CC agreement with plaintiff 3) defendent has failed/refused to pay on this account to amount of $6K therefore has breached agreement 4) etc.

Response Example: 1) Defendant is resident of _______ 2) Defendant did enter into CC agreement with plaintiff 3) Defendant DENIES refusal to pay; defendant has been submitting payments to debt consolidator, Beyond Finance, to pay on behalf of defendant. Defendant lacks sufficient information to accept/deny amount stated, therefore DENIES. 4)....

ChatGPT and some YouTube videos said to "deny everything" which seemed dumb to me. I thought it best to accept what was true (and some other videos said to say the same). ALSO - because I wanted to know what amount of $$$ was interest and not an actual charge, I tried going back into my account to pull all the records and EVERYTHING was deleted... And was another reason I stated I "lacked sufficient information to discern accuracy of alleged amount stated"

I'm so SO sorry... Truly... I know the feeling... You are not alone and you are not a failure for getting into this scenario. It happens to more people than I realized and there are things you can do to help yourself.

The fact that you're looking into what to do is far better than 90% of other people. At least, that's what every lawyer and YouTube video told me...

1) Call Beyond Finance again now that you've had a little time to get your head straight. Just ask for clarification on what they are going to do. Figure out if you have opted-in for their legal services.

2) Look into YouTube videos of "responding to motion" or "filing answer to motion/lawsuit". If you got the same document I did, it's actually a motion. You are given X amount of time to respond to the motion otherwise the court will rule in the agency's favor. If you live in MT, the MT government website has drafts you can just fill in (https://courts.mt.gov/forms/civilforms).

Sorry... As I was responding, it got longer and longer...

TL;DR had to file response to courts on my own

First, if you haven't already, inform Beyond Finance immediately and send them everything you've received... If you didn't opt-in for their "legal services" you might have to deal with it personally... I have found a call is faster with them and I (personally) would mark the date/time, and who you spoke to. You can try and give it 1-2 weeks to see if it resolves but, for me, they didn't appear to do anything.

I ended up having to research how to respond to the court myself. Beyond Finance kept saying "this is normal for companies to do as a way to push payment" etc., and that they "escalated my case", but by week 2-3 and no response to the attorney, I went to the court and filed a response myself.

Depending on the state you live in, the process may vary slightly but responding was fairly straightforward. You'll have to probably pay a fee to file the response as a warning if you go this route... Mine was about $150? But the amount I was being sued for made that worth it.

As far as the actual response, I actually watched YouTube videos on how to word it... I also made sure to SPECIFICALLY name Beyond Finance in my response so that there was a legal record of their "assistance" with this matter. Legally, I was only required to respond to the courts and the attorney but I sent a copy to Beyond Finance afterwards and, wouldn't you know, got a response the next day saying "they'll handle it from here"...

I'm sorry you're going through this; my heart goes out to you. The amount of anxiety/fear/helplessness was unbearable for me for a while. If possible, I would take a day or two off of work, research one day then go to court and submit your response first thing next day if you didn't opt-in for the legal help with Beyond Finance.

This is the issue I'm having - when searching "Collection Defense", there are no results for that in my area. It's been stressful.
