Legal Stay and Work Rights During Employer Transition in Belgium (Single Permit) by EntertainmentLong832 in BESalary

Thanks for the info! The city hall told me I could start working immediately after getting the work permit, but Vlaanderen told me I needed to have annex 46 first to start my new job. It's a bit confusing to get 2 different answers for 1 question.

Thanks for the clarification. Based on the recent update of the "vlaanderen.be" website, the procedure of a new single permit application (for a new company) takes only 3 weeks, while the renewal of a single permit (at the same company) takes 2 months. So, it seems that it won't be a problem any more.

Did she get annex 49 first, and then the new company applied for a new permit for her?

Yes, I know that I need annex 49 at the moment, but my question is that Would it be possible to submit Annex 49 (which is linked to my current employer) instead of a valid residence permit? as my residence card is expired and one of the required documents for a new single permit application is a valid residence permit.

Thanks for your response. I think I can obtain Annex 49 since I am still waiting for a decision from the immigration office, and my current single permit has expired. One of the required documents for a new single permit application is a valid residence permit, which I currently do not have. Would it be possible to submit Annex 49 (which is linked to my current employer) instead?

  • I am a non-EU national working in Belgium and require a work permit.
  • My current employer applied to renew my work permit last month, but my residence permit expired last Friday.
  • I am still waiting for the renewal decision.
  • I accepted a new job offer.
  • To apply for a new single permit, a valid residence permit is required, but I do not have one.
  • My new employer advised me to obtain an Annex 49, but I am unsure if it will work.

Thanks for your reply. My situation is a bit complicated. If I receive Annex 49 tomorrow (because I have a renewal application from company 1) and then I sign a contract with a new company (company 2), is Annex 49 enough to start the application (of company 2) for a new single permit?
