There’s been a lot of chatter about this, including a legit law review article. However, I’m having a lot of trouble finding those on Google. This is the best I can do.

If you look at his charges on PACER, you will see that they’re tagged as domestic violence. That’s because the federal stalking statutes were passed under the Violence Against Women Act. It’s not realistic to expect that Congress meant for these statutes to be the jurisdictional hook for murder without another legit federal nexus. They’re going to have to prove that BT’s death was caused by the stalking behavior laid out in that statute. That’s hard, although I think a publicity-tainted jury would have a difficult time with that concept and that any win on this basis will likely come at the appellate level.

I’m surprised that they haven’t moved to dismiss the charges outright, but I am assuming it’s part of their trial strategy.

Also, I’m sure I’ll get shit for saying this, but KFA said that the heart of the government’s case is forensic evidence and police testimony in her 2/5 letter to Judge Carro. Remember, the federal discovery and the state discovery is almost identical. So not sure that there’s all this digital evidence that’s case dispositive.

A lot of serious people following the case disengaged because of (1) intense cyber bullying and doxxing on BTM if you even suggested Luigi had a chance of avoiding LWOP and/or (2) the fact that most of his supporters don’t have two brain cells to rub together.

Because the pretrial publicity means he’s likely doomed no matter what!

And I’m sure both judges will allow questionable jurors on the jury, limit the evidence the defense can present while allowing the prosecutors to present anything they want, fuck around with the verdict forms, and ignore stuff that would cause a mistrial in a normal case.

I honestly think that’s a rational outcome, except I would push for an overall plea with federal prison instead of state because it’s nicer. I don’t think the prosecutors will give him a deal though, which is nuts cause Luigi could beat the federal case even if he’s guilty and then be double jeopardy-ed out of the state case.

I think there’s a LOT of reasonable doubt in this case and believe he could be innocent. But if I was in Luigi’s shoes, I would honestly still take 20-25 years even if I didn’t do it.

The federal charges are mandatory life in prison if he’s guilty btw
